Hi,

I applied for my wife`s open work permit who is currently in Pakistan and i got a message from CIC asking for biometric and picture in a near VAC. I am currenlty on Post Grad work-permit and have NOC Level A job. I want to know few things.

1) Is receiving message for biometric is a hint of getting work permit?
2) What is the probability of case acceptance?
3) How long usually it takes after biometric to get OWP?

I have also applied for my spouse open work permit online along with my PGWP application. I have job i NOC A. I applied on 19-Jan-2016 and on 20Jan I got same request for Biomatric at nearest location for my spouse. So I think biomatric is requirement, and once they receive the results only then application is considered as complete.
1) Receiving request for biomatric is not a hint for acceptance, its a prerequisite for an applicant.
2) If you have applied with all necessary documents that CIC asked for and some additional documents too, there are very high chances of acceptance, but I have seen some refusals too on this forum!
3)If the application is processed in Pakistan, it will take anywhere between 3-10 months, actual processing time for Pakistan is 10 months these days, but if you applied online, then your application may get processed anywhere in the world at CIC's office, and in that case, you may get update on it earlier.

Biometric is one of the requirement of CIC. I applied for my spouse OWP back in August 19, 2014 online and it was processed in CHC Islamabad office. Received medical request on December 01, 2014 and passport request on January 08, 2015 hope this helps.

P.S: During that time the processing time was 8 months from Islamabad office.

Hi Everyone,

About one month ago I sent an application adding my wife to my valid Work Permit as we got married recently. She has a SX1 visa which will expire soon (July 8th 2016). Her work permit hasn't been approved yet as the processing time was estimated in 3 months by the CIC. I have the following questions:

- Should I apply for any other visa for her along with the work permit?
- If yes, what type of visa given that the SX1 no longer exists, according to what I heard?

We really appreciate your remarks.

Spouse Open Work permit expiring- Next steps??

Hello to all members and a big shoutout to FKL for the phenomenal work you are doing in helping all of us newbies in our transition.

Here is my query -

I am an Indian student and my study permit expires on 30th Mar 2016. I have applied for PGWP in late jan and will be on implied status after 30th Mar.
I currently do not have a Job offer but should have an O class job within the next month, inshallah.

My wife has a W1 SOWP valid till 30th mar and her TRV is also valid till 30th Mar. My 4 year old kid is on a visitor visa. My wife has been working for the past 7 months in Canada. Both my kid and wife have medicals done within the year.

We are located in Kingston, Ontario.

Here are my queries-
1. What is my Wife's immigration status? Is it Worker or Temporary Resident ?
2. Should I file for an Open work permit as late as possible - say mar 25th so that by the time it get into processing say may end, I might have the PGWP and the Job, pay stub etc?

3. If not, should I file for extension of her work permit? is that even possible?

4. Else should I file for a temporary visitor visa for a few months - I think i'll have my job and pgwp certainly within 4-5 months.

5. Is there any possibility of flagpolling for my wife?

6. Should I do a separate paper application for visitor visa for my Kid?

Hi! Is anyone here NOT from a visa exempt country and has flagpoled to apply for PGWP? I am not so sure if this is the right thread but I will be using this for my spouse's OWP.

Hi Guys,

My husband and I applied for visa. My student visa was approved while my husband application for OWP was declined.

Inline with his rejection, these are the reasons:

1. Your family ties in Canada and in your residence
2.limited employment prospects in your country of residence
3.your personal assets and financial status

In the reason number 3, we have not included our banks statements in his application. Thinking our applications are interconnected. For other reasons enumerated, how do you think we can strengthen his next application?

Addenddum: He graduated from Occupation Therapy but he only practised his professsion for 3 years and now he is an Head of IT in the hospital due to his likeness to computers. Probably, we can attached certificates in relation to his profession as IT right?

Many people who are not visa exempt did it. For SOWP, work permit extension or even resident trvs.

However, I don't know any one specifically who got a PGWP this way.

Also note that this is only specific to US border since you do not need visa to enter Canada ONLY FROM US if you have a valid study or work permit.

FKL will be able to answer your equerry, but here are my thoughts,

CIC asks to apply for any service 30 days before the expiry of current documents, in your wife and son case, you should apply ASAP, as their expiry date is 30March.

If you (Principle applicant) do not have job in skill level O,A, or B, then she cannot apply for her SOWP extension, but she can transition from OWP to visitor visa. You need to research a little for that, "how to transition from work permit to visitor visa" this guy did the same thing

You should apply together for your wife and son at the same time, and online application would be a better option as you could see the status and if required could quickly upload required documents.

Regarding flagpole, again you need to research, people got their SOWP but with principle applicant having PGWP and job in hand, in your case, need some deep research.

Could you please share your view on this thought of mine.

I applied for my PGWP and my wife Open work permit together online in last week of Jan-2016 (me in Canada, wife in pakistan) I have full time job in skill level "A", and I completed Masters from Canada.
Previously, two time TRV had been refused for my wife and son, so this time I applied for SOWP.

My questions is, since PGWP is taking 3 months from Canada and Open work permit is taking 10 months from Pakistan, Can I flagpole and get my PGWP now and using Case specific Enquiry for my wife and son visa, send CIC copy of my PGWP?

Because my wife's application will only get completed once they receive my PGWP copy, in that case, processing of her application will start in end of April (When I,l get my PGWP). Please note that although I applied together, but I got 3 different application numbers, one for each of us.
So is this idea worth trying, or if I get my PGWP sooner, her Open work permit will have any problems with this?

Looking forward for your advice.

You could do that and submit proof of having a PGWP and skilled job. But still there is risk of it being processed faster or you not getting PGWP in time along with NOC 0 job. However, if you receive a NOC 0 job offer - you can attach that with your PGWP application and apply for your SOWP together. Since your application meets all needs a) PGWP app, b) Having a skilled job offer c) submitted SOWP along, you are good to go. This is safer than delaying her app in my opinion assuming you can get NOC 0 job offer shortly.

3. If not, should I file for extension of her work permit? is that even possible?
If you do not get a PGWP + Skilled job, you can apply for SOWP, but she would likely be refused and then you would have to apply for restoration of status for her as a visitor explaining your whole situation and would have to stop working during that time.

4. Else should I file for a temporary visitor visa for a few months - I think i'll have my job and pgwp certainly within 4-5 months.
You could do that too depending upon situation. But she has to stop working once her current wp expires and she is not on implied status as a worker.


5. Is there any possibility of flagpolling for my wife?
Yes, because she is already admitted to Canada as a worker. However, she has to have a VALID permit when she goes for flag polling. Plus she has to be eligible for SOWP then. Which means proof of your PGWP + NOC 0 job

6. Should I do a separate paper application for visitor visa for my Kid?
Why would you complicate your family's situation by separating out applications? This would only do damage and get you refusals. When you apply online for yourself or for your spouse, include your kid in the application as dependent. Your wife (in case of extending status as a visitor and not SOWP - as well as your kid would both NOT BE GETTING regular visitor trvs. They are still dependents of a student / work permit holders and their permits would be assessed by the same Visa office which handles work permits. This is different from regular trv that one only applies for visiting entering Canada and is processed by a different visa office.

First of all I am not sure right now its taking 3 months to get PGWP from in side Canada. They recently changed time frame - some people got processed in 2 months or less - others are taking longer. So this is kind of unpredictable.

When you go to border and get it technically though most likely you would loose your first application's fee. Plus I am not quite sure how CBSA would handle the case with an existing application online. They would ask why you had to come over and need to be convinced (say you have a job offer and need to start right away).

It is not like processing of your spouse's application starts AFTER yours is approved. If you applied together - it is possible that they process them altogether although hers might be delayed a little due to visa processing aspects that are local to Islamabad office (if any like passports).

You always get 3 application numbers irrespective. When I applied years ago from Pakistan for LMIA based work permit for myself, and those for spouse and kids, we each had a different file number. The file number also varies based upon type of your application. For workers, it W000.. vs S for studypermits and V.. for resident visas for children.

U should submit your valid passport booklet and previous passports to vfs if you are submitting a paper based application.

I submitted my sowp application two days ago to vfs. I submitted my original passport( the booklet) and a passport photocopy ( photo page and address page) along with my supporting documents.

If u are doing an online application, you should submit your original passport to vfs on request by CIC to stamp the visa in your passport.

I hope this helps
