Hi Kumar,

I am not exactly sure what do you want me to do. If you follow the instructions on the link, you would create an online account in which you would have forms to fill and upload along with scans of all documents needed.

Payment for online application is made through credit card only which would be asked for at the appropriate step.

Hope that answers what you were looking for.

Hi

I have recently come to Canada on dependent visa. My husband is working here with closed work permit( valid till march 2017). I would like to apply for open work permit. I would like to know where to apply and all the documents that are needed for open work permit.

Thank you for the help Fkl. My fiance/wife just received her stamped passport with the visa and the letter of introduction last week.

I can help people out here if they have some questions around what documents need to be included while making the spousal open work permit. I will try and share my 2 cents, for expert questions please direct them to Fkl - the champ ;-)

Open work permits to applicants for permanent residence under the spouse class

Hi All,

I am a Permanent Resident holder living in Canada. My husband is currently working in France on a Work Permit visa.
I have applied for my husband's spousal immigration (PR) on 13th Dec 2014.

We just got to know about the "One Year Pilot – Issuance of open work permits to applicants for permanent residence under the spouse or common-law partner in Canada class" and are planning on applying for this Open Work Permit for my husband.

1. Can somebody provide the document checklist to apply for this visa?

2. Financial proof - Can I show bank statements on behalf of both of us OR does my husband have to show his bank statements only OR do both of us have to show our bank statements individually?
Note: We do not have any joint accounts or investments as we are newly married.

3. Does it matter as to who posts the application to the CPC office? Can I post it from within Canada or is it necessary for my husband to post from France since he is the applicant for the Open Work Permit?
Note: We cannot apply online as we have not received any approval so far. CIC states that the application must be posted in cases such as ours.

4. Should my husband provide his education records, past & current employment letters, payslips and tax statements for 3 yrs?

5. Should we fill up any other forms apart from IMM5710? For example, Family Information, Travel History, etc;?

6. Should my husband get his medical tests done before applying?

7. Should we include a cover letter? If yes, what should be mentioned in this letter?

8. Where can we pay fees for this application?

It would be great if someone could clarify this for us.

@kamatmahesh you are most welcome :) and congratulations.

It would be great try helping others and it is all just sharing ones own experiences. We are all applicants to CIC at some point in time. The only difference is that some only resort to the forum when they needed some info and never came back vs trying to share who you know yourself.

And it is useful to one's self as well. This forum is still a major source of info for me.

You can apply for his SOWP along with your own WP renewal application assuming you have a skilled job NOC 0, A or B. Processing time is roughly the same as that of another work permit. On line application is generally faster and currently stands at 38 days. Paper application is much longer - around 3 months or so currently.

You will get check list when you fill application package online. Otherwise it should be available on your local CIC website (France) under work permit heading.

His own funds are most relevant (in his account) though yours statement along would help so submit both.

YES - He is the applicant. There is no way you could do this from within Canada. The only option is applying online where you fill the application for him (not known to CIC obviously). Still it would be processed at the CIC embassy catering where he currently resides and processing time from there would apply. I don't understand why you say you can't apply online.

Educational records and employment letters - YES. Pay stubs, just a few recent ones should be more than enough.

Family information form - yes. I don't know if travel history is turned into a separate form. Earlier it used to be part of main work permit application forms.

6. Should my husband get his medical tests done before applying?
Depends upon local embassy. Check first if he actually needs medicals being in France.

7. Should we include a cover letter? If yes, what should be mentioned in this letter?
Only if you need to explain something not otherwise obvious from your application and you think is really important. INVITING your husband to live with you is obvious and doesn't need a cover letter. However, you should attach proof of your sponsorship application in process already.

8. Where can we pay fees for this application?
Using credit card if applying online. If for some weird reason you have to apply on paper, the details (bank draft, pay order etc.) are usually written on the local cic website which would process his application. Google CIC france.

It would be great if someone could clarify this for us.

Time lines vary greatly by embassy / country. Where did you apply from?

Assuming your husband has a skilled job NOC 0, A or B (else you are not eligible for SOWP), you should start here

The application is the same as that of a normal work permit holder. Just that you would choose type as "Open", in details of intended employer in Canada would write "Not applicable" and instead attach proof of your relationship and your spouse's work permit and job details.

Hi Fk;

I am new to this forum. I need some expert advise regarding filing sowp. I am on post graduate work permit status in canada and my spouse is working in USA on work visa. I have a NOC B category since last june which I quit in nov and went for break for two months and now again I am joining new company with same job profile from Feb. I have few quick questions regarding filing SOWP.
1. What is the detailed checklist of documents required for filing SOWP.
2. Do i have to show information (like pay stub, job profile) from both of my employers previous and current.
3. Would my 2 months layoff affect the Sowp.
4. Should i file SOWP asa i recieve my two paychecks from the new job.
5. Do we require PCC for filing SOWP. My spouse already has canadian visitor visa since last 3 years.
6. Does my spouse has to show funds and if yes how much and does she has to provide any letter of intent regarding current job profile.
7. Do i have to provide any letter of intent regarding my job profile and what amount of funds do i need to show.
8. Apart from marriage certificate and some photographs do we need to show any other document justifying our marriage.
Experts kindly give your inputs. Thank you in advance!!

Good day guys!

I am fairly new to this forum and I can see that a lot of those inquiring have had their lives changed by the people who shared their knowledge and expertise on the subject. Kudos to all of you who did it without asking for anything in return!

Along with the many newbies here, I too, am an aspirant of an OWP. Here's how my story goes:

My wife has already been nominated for PR (after being promised of it and after 6 years of waiting and transferring from one employer to another to another). She is just waiting for her approval through the SINP as a skilled worker. My eldest daughter and I, applied for study and open work permits, respectively, last year (January 2014) but got denied. At that time, there was no PR application for my wife yet. I am now once again going to try our luck to apply for the same but this time I would like to be sure of what the necessary documents and steps I should take to avoid being denied the second time. One of the posts I have read says that it will be hard to expect a positive result the third time if you get denied twice.

On February 27, 2014, I received a letter from the Canadian Embassy in Manila stating the reasons for the denial. Here is what it says:

"You have not satisfied me that you would leave Canada by the end of the period authorized for your stay". On the subsection, what was highlighted was: 1) your family ties in Canada and in your country of residence, 2) your personal assets and financial status

Also, in "Other reasons", it said "you are or will be unwilling to support yourself or any other person who is dependent on you, and have not satisfied an officer that adequate arrangements for care and support, other than those involve social assistance, have been made.

As for my daughter, the only one marked why her application for student permit was denied is about the "Other reasons".

What I did not understand was, we were advised by our agent in Canada to have our Medical Exams already prior to the receipt of this letter and we underwent the same only to find out we will get denied.

Any feedback to this inquiry would be most appreciated.

I'll explain my situation.

I have graduated Aug2014 and got my 3 years PGWP in November. I am working full time, permanent job on NOC level B. My boyfriend came on Student Visa in Jan 2015.
Now we are thinking to get married.
So my question is once we get married, can he apply SOWP within the Canada as my husband based on my work permit.

Please help,
