Spouse Open Work permit

FKL and seniors, I need your input please,

I have applied for my spouse open work permit and my son's TRV along with my PGWP application in last week of Jan-2016 ( I have "A" level skill job). I have my convocation in June and I desperately want my family to attend that, but I am not very much hopeful about SOWP getting processed that quickly.
I am visiting Pakistan in April and I want to apply for my spouse TRV again, so that she might get this time. (When I was studying in Canada, 2-TRV applications were refused for my spouse and kid).

My question is, is this legitimate to have two applications one for TRV and one for Work permit at the same time? (Work permit application had also TRV form in it).
Is this option workable? and would this new TRV application have any effect on her Work permit application?

Are you student, studying full time in Canada, or are you working in skill level "A" "B" or "O"?

If the answer is yes, then yes you can apply for his SOWP. Attach all necessary documents and explain clearly in cover letter that your previous TRV for Canada were refused, but now you are applying for SOWP. On top of your letter write

R205(c)(ii) LMIA excemption code C42 (Assuming you are studying) so that VO apply the right rule to your application.

I read your post after my application. so, I can't mention the rule in my sop.

However, the rule says if the spouse is an international student in a DLI and spouse clears medical examination, then the spouse is eligible for SOWP and there is no other eligibility criteria mentioned.

Check the exact line below.

"Spouses or common-law partners of full-time students are eligible for open or open/restricted work permits, depending on whether a medical examination has been passed. There is no need for an offer of employment before issuing a work permit."

If that is the case, why would they refuse the applications even applicant fulfil the requirements above.

I have a quick question, I saw that some the people did notarized some letters when they submitted them to CIC. I would like to know what kind of letters need to be notarized and is there any reason for notarizing them?

My intro: i am a student in Canada, my spouse applied for SOWP from Pakistan.(Paper Application)

my spouse got an email from cic to submit my fall semester results. Well she submitted my official transcript along with her application. I just want to know that we should mention in email that we sent official transcript and unofficial print is also attached with this email????

I'm creating the SOWP file. I'm planning to create put chat history from watsapp and other apps. what is the best option to put it is it by taking screen shots and keeping them in a document or by exporting the chat history and keeping that.

Also I don't want to share my personal messages with CIC. what is the best option?

When can i apply for my Spouse Open Work Permit?
After I enter in Canada or My Spouse should be in Canada to apply? Or from here(India) itself can i apply for his OPen WP?

From what I know, two applications shouldn't impact each other. But stating purpose as VISIT for a spouse of a PGWP holder is generally wrong (since spouse normally isn't a visitor, they intend to live together and its hard to prove visitor intention unless you have been visiting many other countries previously etc.). So my expectation is that if you try visit visa (shorter duration, not requiring medicals and not getting them healthcare in Canada), it has a high chance of refusal again.

As opposed this, your current application in process, for SOWP and resident trv for your child assuming you have a NOC A job and PGWP, should be through in time hopefully for the convocation.

Of course this is just an opinion.

Translations of docs not in English or French or when applying on paper, you submit a paper photo copy OR actually submitting an affidavit for some thing e.g. as confirmation of a name change. These are some scenarios in which people submit notarized docs.

Generally for an online application with a doc being in English or French, you do not need notarization.

Your official transcript contained fall semester results? Rest of the answer is YES - attach it and mention submitting this in the email too. It doesn't hurt to provide info twice.

I don't think it makes much of a difference. Just try taking actual log files generated by the application (if screen shot, you can cross personal info in paint), so it doesn't look fabricated or any thing. Exporting history and removing some of personal content is also fine with the above caveat.

You didn't mention what type of work permit and job. You have to have a skilled job for SOWP eligibility.

If you have that, your spouse can apply now as well in the home country OR he can apply from in side Canada as well.

However, the processing time can vary based upon location i.e. it could be faster from inside Canada.

But don't do both - i.e. apply from india and then move to Canada WHILE the application is in process.

When did you apply for your spouse open work permit in Pakistan? How many months have passed? Has she received request for medical exam too?
I applied for my spouse, online in last week of Jan-2016 with upfront medical exam.

Thank you FKL for your support and guidance, your words "Your application for SOWP and resident trv for your child should be through in time hopefully for the convocation" are really sweet. :)

I wish and pray it happens before my convocation in June.

That is what the law says, now it is upto the VO how to apply this, sometimes they mess it, and some times it us who do not provide "documents" that VO needs!
The best we can do is to follow the law and should prepare documents according to requirements as set in those rules.
