Hi Everyone
I applied for SOWP and it got rejected so we applied for gcms notes and we got the reason as this "Im currently Full time employed in skilled job so why would i leave my home country and move to Canada and initially be unemployed and it says that i have low income and savings and i would initially depend on spouse and spouse show low earning and modest savings and spouse circumstances do not demonstrate an ability to support and additional person not satisfied PA please initiate refund "it says.
Help me in what to do in this case if i reapply what all supporting documents i need to keep? Please reply ASAP.

Hi Bede,

Sorry to hear that. There are many people in your situation who got their OWP.

Having a job back home is definitely a positive aspect of your application. I would say the funds are not sufficient.

Anyway for your next application, try to show more funds to prove you can support yourself.

Your salary account may not sufficient. Have some fixed deposit that can be liquidated when you need.

Show more funds in your personal bank account and get at least 2-3 months bank statement. Don't deposit huge funds at a stretch though.

You must show minimum $10-15k in your name in addition to your spouse's savings.

If you don't have a FD, then create one. And yes, you have to wait 2-3 months. There is no official time limit for keeping the funds in your account. But having the funds for more time will make a positive impact.

Also, if you deposit huge funds into your account then that is also a problem.

Virtually, you are talking about sponsorship from your parents. That can be added as an additional support but cannot be taken into account as primary source of fund.

You can show your parent's properties for back home ties. You can show the properties of your parents along with the legal heirs certificate to prove you have share in it (Everything should be translated when needed)

As long as SOWP is concerned, you must show funds either in your name (preferred) or your spouse's name.

Don't go for visit visa. They may doubt your sudden mind change after refusal.

Keep your intention clear that you are going to work there on SOWP.

Wait at least for one month after making deposits either as FD or savings account or both.

I have just sent you a personal message. Please check.

Did you get your GCMS notes ? Please share it here. Let you and bede make an application package together for your next application.

Also let experienced members like fkl and others review it before you apply.

Keep it posted.

Cheers.!

Re: Spouse Open Work Permit - 2016

Hello Everyone,
I am in Canada since 2.5 year. I am working skill level B position and have a post graduation work permit. I have applied for the SOWP in 21-.Jan-2016. However got rejection on 21 March 2016. The letter attached with the passport does not clearly mention any reason. The oter reason box was checked and the message below is : From the documents which you have submitted i am not satisfied that you meet the requirements for issuance of open work permit under C-41.
I have submitted all the required documents. Can anyone suggest or have the same problem and what they have done.

Thank you in advance.

It is very sad to hear that. here is the link for C 41 exemption,
http://www.cic.gc.ca/english/resources/tools/temp/work/opinion/policy.asp

In summary, CIC was expecting the following documents from your side,

1. A letter from your employer that says you are working in NOC "B" and that letter should also include duties that you perform. These duties must match with your NOC code. For example, if you are working in NOC-2133, your job duties should match those roles which are mentioned under this NOC.

2. You should have attached last 3 payslips and bank account details to prove that you are earning sufficient money in skill level "B"

3. Your PGWP must be valid for more then 3 months.

If you had missed any of these documents, you should re-apply, and dont forget to attach these compulsory documents.

Thanks b4ahmad, I have attached the all the documents you said but in my job letter the HR didn't put the NOC. But i have attached a notarized copy from attorney stating that i am working x position fall in NOC B and code xxxx. But they just said other reason. So i need to reapply with the job letter with noc code and all the duties included.

Hi all

My open work permit got approved for the third attempt . My husband is a student and my first two applications got rejected. Third time I applied in through a immigration lawyer and it was online application.

I know how bad it feels when we are away from our spouses. I advise to go through good lawyer. I approached two different lawyers .the first one wasted huge amount of money and done nothing. Please do a good research on lawyers and proceed.

Hope this information may be helpful

Thank you and good luck
Please can you tell which immigration lawyer you approached who made your application approved

Hi,
I applied for my husband for open work permit on August 22, 2018 and the immigration refused the file on November 20, 2018 saying that you have not demonstrated that you meet the requirements of an open work permit under section 205(c)(ii) of the Regulations.

Please help me. I want some advice. Even, my agent now applied for CAIPS.
