Hello everyone, I have question about spouse open work permit applying from inside Canada.

I have applied for Express Entry under CEC with my spouse. I am the primary candidate and score is 470. We are currently both on PGWP inside Canada. My PGWP is expiring in March 2023 but my spouse has it valid until December 2023.

Ques
Can I apply for spousal open work permit on behalf of my spouse and get a WP until December 2023?

If so, can I go to border (port of entry) to get it quickly? What are the steps?

Note that if you came to Canada on a study permit first before your spouse, you cannot obtain an open work permit through your spouse due to the foreign principal national rule.

If you came to Canada first on a study permit ahead of your spouse, then you do not qualify for a SOWP. You options are to convert your status to visitor and remain in Canada without working, find a job offer and approved LMIA so that you can switch to a closed work permit, or to leave Canada.

We were not married at the time we came to Canada and got married in Canada during our PGWP. Will it make any difference?

I don't think that will make any difference to IRCC. However no harm in trying. Make sure you know what your back up plan is in the event you're denied since that's a very high possibility.

Hi,
Im a Permanent resident and i want to apply open work permit for my wife. While applying there was one question which says:

Are you a spouse, common-law partner or dependent child of a person who:
  • Holds a work permit or is applying for a work permit
  • (only spouses or common-law partners) holds a study permit and is a full-time student in a post-graduation work permit (PGWP) eligible program of study at a PGWP eligible designated learning institution?;
  • holds a temporary resident permit that is valid for 6 months or more;
  • applied for permanent residence to an office in-Canada and was determined to be eligible for permanent resident status (first stage approval); or
  • is subject of a removal order that is unenforceable

what should i select YES or NO?

And another question is should AOR mail should be attached in supporting documents while applying open work permit? As I see there is no upload option for AOR letter.
