Spouse of Canadian Citizen living abroad with husband

Hi everyone,

I have a situation here to handle and would be great full for any support.

I am a Canadian citizen living in Dubai for the past 7 years with my wife who is a PRC and have been living with me every since we are married.

She has already renewed her PRC twice and last time during her application filing of RC renewal the immigration lawyer had told her that this would be the last time her PRC would be renewed even though that her husband is a Canadian citizen.

My understanding on the subject is that a PRC holder and spouse of a Canadian citizen living abroad does not come under the residency requirement.

Now that her PRC status is expiring next year in March so we are a bit worried about the options available to us to choose from. Please help...

How was she getting them renewed if she was not in Canada? They will not send them outside the country.
While she is not in breach of the residency requirements, she may have a greater burden of proof required now?

I would call CIC because as long as your wife is with you it doesn't matter where in the world you are. They might have a limit to the number of times but I haven't seen that listed anywhere on CIC's website.

And Zardoz, you can live outside of Canada as long as your with your Canadian spouse

As I said, she is NOT in breach, but you still need to prove that you are together outside of Canada.
After a couple of renewals, CIC might be more suspicious that you are not actually together any more.

Was this just what the lawyer said or did CIC make an official (aka written) statement?

The lawyer could just be wrong. Wouldn't be the first time.

Thank you to all for the help.

Last time she visited toronto and applied for her PRC and travelled back to Dubai, we have been together with 2 kids and there are many proofs. Last year I even have applied to sponsor for my kids but the application was rejected due to the reason that immigration officer was not convinced that we will ever be moving back to Canada.

Now my wife's PRC is expiring in March 2014 and we are planing to do the same thing as we did last where she will visit Canada and will apply for the renewal. Please advise what kind of proofs would be sufficient to show to the CIC incase they want to see some proofs.

Many more suggestions to come I'm sure, but the first thing that comes to my mind is whether you are renting or own property abroad . . . your land title OR rental agreement (lease) with BOTH your names on it would be a very good start.

Aren't the kids Canadians as well as you are Canadian?

It's entirely possible he's a naturalized citizen and the children were born before he got his citizenship. Then they would not be citizens. Same goes if he was also born outside Canada.

There might be a concern because she enters Canada only to renew the card. To a casual observer, it might look like she's "gaming" the system. (Which she isn't because she's living with a Canadian husband.)

My question: has she ever lived in Canada? There is a line in the PR guide that if you live abroad permanently with your spouse Do Not sponsor until you intend to permanently return to Canada. If she landed and left to go abroad right away, I could see this maybe raising a red flag as she never intended to live in Canada. However, I doubt CIC would do anything about it because she is living with her citizen spouse overseas as she is allowed.
