Hello, I need some information regarding spouse visa in following situation:

I am Permanent Resident in Canada from last 2 years staying in Winnipeg, Manitoba. I have married an Indian national girl who was earlier married in India in to an Indian national in 2008 and after their marriage they went to Australia same year. After 5 months of staying there, she get separated with her ex-husband and return to India while her ex-husband keep on staying there on his temporary visa. After separation, they got there mutual divorce filed and approved in Australia in 2013. In March, 2014 she got re-married to me.

Now someone told me that it is mandatory to add spouse surname(my surname) on her passport in order to get spouse visa of Canada.

If yes, is her Australian Divorce Certificate valid for re-issuing her Indian Passport or we should get an Australian Consulate/Embassy attestation or notary attestation will be enough?

I am not sure where you heard this, but i would say no. Whether a person takes the last name of their spouse has no bearing on whether they are approved or not for PR.

IF she chooses to change her passport/legal name, each country has their own rules about how to go about that, so to know for sure for india, i would suspect you would need to go to the embassy website to find out. I don't see why a divorce certificate would be needed unless she wanted to change her name back to her maiden name. In order to change her name to yours, my guess is she will need to submit your marriage certificate. For a US passport, all that is needed to change a name for marriage reasons is the current passport and the marriage certificate.

That's correct. It's not "mandatory". We did so since we thought it would help our case. In the end, I'm confident that it made no difference for OUR application, but ours was processed out of Manila. I still think it could be helpful in some cases, but certainly there is no requirement to do so.

Definitely not .In Canada your maiden name is always a legal name. If she wanted to change her name back to her maiden name thats all she needs is her birth certificate and some other id, its pretty simple, i did it. Also for her to change her name to your surname thats all she would need is the marriage certificate and some other id.She does not need to have your surname on her passport to get her PR.
Many women in Canada do not change their names when getting married, for professional purpose,some will chose to hyphenate there names e.g. susan James-Jamal.

There is one thing I have to agree with: She doesn't need to change her name to yours in order to get a visa in Canada.

One question: which name is she using now? That of her ex-husband?

I have to add though, that some advice here is not entirely correct. Just because in your country you can change your name back to your maiden name or to your new spouse's name without a divorce certificate, doesn't mean that everywhere around the world is the same. So unless you know exactly what India's regulations are, please don't tell people that it's ok.

Better to add your name to her passport, Your Indian address (i am sure she is living at your parents house), change surname.

Tell her to buy a Cell phone (postpaid), on which her name, wife of and address is appearing.

These things will surely help.

As per Indian Passport Act, name of spouse is mandatory (if married). So Canadian High Commission in India, religiously follow this as a check, though it is not mandatory in Canada.

Even on your passport spouse name has to be changed or entered. She need copy of your passport (showing your name as spouse), when she apply for new passport with new details.

You need following items /record to get new passport

1. Marriage Certificate
2. Divorce Certificate (if you are previously married), if this divorce certificate is out of India, then certified copy of divorce from Indian High Commision in Australia or Australian High Commision in India.
3. Copy of Joint Bank Account (if any), account should be nationalised bank.
4. affidavit from you and your wife
5.address proof
6.Aadhar Crd, if any.


Now a days , passport applications are taken online In India. Appointment system is there.

Please keep it in mind...Reissue of passport due to marriage is never done under tatkaal (super fast service of passport india, where one can get passport withn 2 days)...it is always under normal .

I pointed out quite clearly in Canada . It doesn't matter where you were born or where you were married , this is Canada rules , so if his wife is here in Canada then this is possible to do .
