Spouse accompanying International student

Hi Guys,

My wife is planning to study in Canada, she will go for an ESL course in a language center and then college which the total study time will be vary from 1-3 years. I have a couple of questions before we apply for her study permit/ student visa.

1- If she is planning to start the study March 2018, when is the best time to apply for the visa/ study permit. some people advised me to apply 3 months in advance and not longer than that as the initial visa to enter Canada will be valid for 90 days only. Is that correct or she can enter Canada whenever she wants during the 2 years study permit period?

2- If we get an acceptance letter for 9 months (1 academic year) to apply for the visa, do we need to contact the college as well to get another acceptance letter from them? Or we can do that afterward when we are in Canada and about to finish the ESL (English course)? I mean, does the visa officer will grant her visa for 3 years or only one year with the language center acceptance letter?

3- I couldn't find a place in the study permit application to explain her study scenario in details, where can we include a letter to the visa officer?

4- I'm applying for an open work permit to support my wife. Do I need to provide a return ticket with my application? IAs we are going to stay for 3 years; I couldn't find a way to book a return ticket for that long. What is the alternative way for this to convince the visa officer that I will leave Canada after her study time? Please note that I already have a visit visa to Canada that will expire in 2022. And I have 3 visas to Canada since 2012 and I never stayed illegally in Canada more than 2-3 weeks every time I visited the country.

5- Do I get a work visa with the open work permit? Or I will enter Canada with my existing visit visa? Do I have to leave Canada every 6 months?

6- We will make a visa application for our daughter which is 1 year old. Does she get a normal visit visa? Or a special type of visa to stay with us for the entire period of 3 years? I know that the normal visa allows the visitor to stay only for 6 months and then he/ she has to leave Canada and comes back. Does this rule will apply to my daughter?

You need to change your plans if you want to have a decent chance your plans will be doable and be able to travel to Canada as a family. Your wife should avoid going for ESL studies and gain admission to the college program directly - even if this means delaying her studies. Study permits for ESL programs have high refusal rates (CIC doesn't generally see this as a genuine course of study).

She will study English for academic purpose in a language centre prior to the college program. Not sure if this considered as ESL, but it called EAP. However, when I was in Canada the language centre is full of students went there based on this plan to study academic English preparation course before applying for a college.Even I met a couple of guys who have similar scenarios and coming from where I live.

And BTW, if the application gets rejected, are we allowed to resubmit another application at a later point?

However, when I was in Canada the language centre is full of students went there based on this plan to study academic English preparation course before applying for a college.Even I met a couple of guys who have similar scenarios and coming from where I live.

And BTW, if the application gets rejected, are we allowed to resubmit another application at a later point?

1. Attending an ESL or any language course, will not give you a spousal work permit. So you won't be able to apply for a work permit until regular classes start.
2. You can submit as many applications as you like. But if you haven't overcome the reasons for the original refusal, it will be another refusal.

When I was in Canada a week ago, I met a student advisor in one of the language centres. She told me they will issue an acceptance letter for 9 months (1 Academic year) for my wife which will be prior to the college program. Also, they have a pathway to colleges like Centennial college in Toronto (Where we are going to stay).

Anyway, when I explained our scenario to her, she also told me I will get a work permit for 1 year without any issue. Not sure, if that's possible or not. Or she just tried to give me a hope to apply and pay the fees upfront without having the sufficient knowledge about the case.

Okay, if that language centre is listed as a designated learning institution in the CIC website. Do you think there is still a chance for me to get the work permit?

Honestly. we found the English program for 9 months is the most suitable option for my wife as she never been in an environment where everyone speaks English and I thought she may find it quite difficult to deal with people without proper English skills (General and academic). That's why I wanted her to join that course to get herself up to the standard level before going through the academic experience in Canada. Though it will be an additional cost on our shoulders.

Did you guys apply and got a student visa with ESL Program? What about open wok permit?

- In my case, I am the husband and planning to take a program in George Brown. I just took academic ielts so I can avoid the ESL program which will be an additional financial burden on our part. Moreover, I also planned to include my wife and my 1 year old daughter where my wife will have to get OWP. Hence, we were advised that the best time for us to apply for the OWP for my wife is when IF/I receive the guarantee for my Student Visa. Why? this way, it is safe enough for immigration to think that I have strong family ties to go home after my studies. Although, you all(family) can apply and submit all together but the big risk of getting the refusal is there.
