Spousal Sponsorship

Hello,

I am trying to sponsor my husband but I’ve a situation and I don’t know if they will accept my application and everyone I communicate with are giving me different answers.
Here’s my case:
- I was sponsored by my brother before I got married.
- I got married and was called for an interview and when they asked if you’re married or have anyone in the interview, I told them NO I don’t have anyone because my brother suggested I say that and it has been my biggest regret. Anyways, when I got to the airport, they asked me again if you had left anyone behind and I mentioned I am married and here’s my marriage certificate. They asked why I didn’t mention that during the interview since the marriage certificate indicates the date was before the interview. I told them my brother told me don’t mention it and I did that without knowing. The officer wasn’t happy about that but they put that Yes I have a dependent on my confirmation PR paper. Does that mean, I could sponsor my husband based on that YES or it might get denied so I’ve to go back and marry him again??

Agree you need to speak with a lawyer. Since your husband wasn't examined as part of your application, this would normally mean you can never sponsor him.

How were you sponsored by your brother (under what program)? What age were you?

I'm trying to grasp why your brother counselled you not to include your spouse. That decision - and the decision to get married before you became a PR - were very bad choices. Any competent lawyer (or anyone familiar with immigration) would have told you / your brother this before it was too late.

Perhaps a lawyer can help you now. But chances are not good.

I’m still trying to understand but we’re no longer in a speaking terms because of this so I will never know why he advised me not to and trying to figure out away if this will ever be possible. Some they keep telling me to go back and “marry him again” but how?? Does having a dependent on the confirmation of PR papers when entering could mean having a spouse or only children? They didn’t specify married or left a spouse behind just yes to having a dependent.

Marrying again won't fix the issue. Talk to a lawyer.

Sorry to hear this. I can't think of any good reason to have not included your spouse in those circumstances (if you had been quite young, conceivably). That said, I do not know the type of program your referring to well.

Does having a dependent on the confirmation of PR papers when entering could mean having a spouse or only children? They didn’t specify married or left a spouse behind just yes to having a dependent.

The dependent eg spouse's information should be entered in detail, and (normally) have been examined for medical and criminal background etc beforehand. Just writing "yes" is unusual. (In similar circumstances often the applicant - eg you - is not 'landed' at the time but told to return and complete the proper procedures).

That's why you need a lawyer. Again, usually this means he can never be sponsored. But in circumstances where you did disclose - perhaps there is something to this (you didn't 'misrepresent' at this stage - although you did before). So perhaps a lawyer can assist.

Also make sure you don't travel back to your home country or country of persecution if different until you have Canadian citizenship.

Assume there may have only been the funds for 1 person or sponsorship was sold as single woman all alone.

In which case simply should have told the applicant that she should not get married until landed.
