Thanks for your information. I am a Canadian Citizen and facing problem to take my wife back to Canada. I had sponsored once for my previous wife on 2008, but she left me before the procedure ends, then, I cancelled the sponsorship. However, I got married again and applied for family sponsorship for my new wife on July, 2012 and came back to my home country, Bangladesh. But Unfortunately, this time, she is refused after facing the interview on October, 2014. The Immigration Officer asked her a lot of questions about my previous marriage and make her panic and nervous. And finally, we came to know about the refusal on April, 2015. They (Singapore Office) shows the reason of refusal in the letter like - "Based on the assesment of your information including your application the supporting documentation, and the information you provided during the interview, I am not satisfied that your marriage, common-law-partnership or conjugal partnership is genuine or that it was not entered into primarily for the purpose of acquiring permanent residence in Canada. Therefore, as per the regulations, you are not considered to be a member of the family class." I also have sent CD-ROM drive of our marriage and other documents to the Appeal Division on May 2015, but they returned them back and replied with the confirmation of refusal on June , 2015.

Can you please advice, what I can do next. I can not go back to Canada now, just because my wife is expecting and I have to take care of her. Can I re-apply from here in Bangladesh and how? How I can make them understand that our relationship is genuine.

At July 15, 2015 received email that asking for medical exam (bcoz the old one expired), Police certificate and pay the RPRF( with a note said " Please do not submit your pasport until your sponsor has paid the RPRF in canada, and he paid on July 19, 2015)
I received this email, after i landed in Toronto as a tourist. I was on my holiday to visit my husband there.
I sent all the additional document on Aug 5, 2015, i also sent them my pasport (bcoz we already paid the rprf). They received it on Aug 11, 2015.
And my status changed from in process to decision made.....

My question is...

1. What is the decision made" words mean?? bcoz when i click on my ecas status it said "We sent you correspondence on July 15, 2015. Please wait until you receive the correspondence before sending us additional information, as the correspondence will outline all information that is required." Two part question. My spouse is korean and we want to do an outland sponsership method. But im concerned about the work permit. Im not sure if she will be eligable for a closed work permit to come to canada. She is just a regular worker, with customer service and personal training skills. Does anyone have any insight on this? Can she come to canada and apply for jobs for the work permit or must that be done before entering the country?

Secondly, ive read that spouses of international students can apply for work permits and come to canada if their spouse is a full time university student. Does this apply for canadian citizens? For example, could my spouse get a work permit in canada if i were to be a student?

Thanks, any insight if appreciated.

Well it seems to me they received all they needed and now you are approved (DM), you already sent your passport so they would not need to send a PPR. The July 15th correspondence was the email requesting the additional medical etc. Don't worry that it's still on ECAS, that is meaningless, what matters is the DM.

My only concern is you are now in Canada as a visitor, where did you specify them to send the passport back to?

I don't know of any ways she can get a closed work permit, without connections. You have to have a job offer from outside the country. So, you likely have to have important skills or education that a Canadian can't do. Look into if there is a working holiday visa option for South Korea, if she is young enough and went to school in the last year. She only has to have enrolled in full time school, which is a bit of a loop hole.

Sorry, you are Canadian, not an international student, so you don't qualify. I know it's a little messed up. I guess they do that as many international students don't have support here.

If you apply outland and she wants to work she will likely have to stay in Korea, or get some kind of remote job from a non-Canadian based country.

Hey experts,

When do you recommend the first ordering of CAIPS notes? Our VO (Amman, Jordan) likely won't be sending out an AOR2...and as of now does not have a posted processing time :(

It would just be nice to know that the application is in the Amman VO....as I'm sure it won't be looked at for a few months yet.

Is it worth obtaining CAIPS notes for this? How long after the SA approval letter (when they indicate where the file has been sent to) should I wait for?

Also, on the topic of current processing times, please consider sending a letter to your MP and signing the petition (included in my signature below). Hello,

My wife is from Macedonia. She is here on a multiple entry tourist visa. She is allowed to stay for 6 months at a time. We just got married legally on Saturday August 22nd so we can submit the inland sponsorship application. I have a few questions that I have been unable to get confirmation about. Can you please help me?

1. Can we use the temporary marriage certificate as part of the inland sponsorship application or do we need to submit the official marriage certificate? We would like to get the application sent in along with the application for work/study permit specific to inland sponsorship applications so she can start working and studying ASAP.

2. Can she leave the country in May for a wedding even if she isn't yet a permanent resident and will be here on the work study permit (assuming she is approved)? Will she be at risk of being refused entry when we return even though we are legally married?

3. Does she need to extend her tourist visa if she doesn't receive approval of her work/study permit before her current tourist visa expires? I was told the government is doing everything it can to process the work/study permits for inlad sponsporship applications as quick as possible, usually around 2 months. However, if we don’t receive the decision before her current tourist visa expires, would we need to extend the visa?

That's terrible news. So if we apply outland korea and i go to canada to live then she can still come visit on a tourist visa right? If she is accepted while on a long term visit, does she need to go back to korea or can she just stay? Also, from all account read it will take two months for her processing time (korean) after they determine if im fit to sponsor her. So in a perfect world she could be in canada living in four months and able to work? Also, im going to be going back to school, but as long as im working part time i should be able to sponsor her right? This is incredibly helpful, thanks a lot!

You are a bit confused between outland and inland sponsorship. Yes she can visit on a visa and renew the visa inside Canada while applying OUTLAND but she still will not be able to work. There is something called "dual intent" which makes it ok to want to visit yet be applying for permanent residence, but to obtain a tourist visa you still need to show strong ties to your home country. http://www.cic.gc.ca/english/resources/tools/temp/visa/dual.asp

The 4 months for a work visa is if you apply INLAND. This is a whole nother ball of wax. If she's in Canada as a legally as a visitor, she can apply to the OWP pilot programme at the same time as her inland application, and get an open work permit in about 4 months that way. However the downside is that there is an up to 2 year processing time for inland sponsorship to get her PR, and it is not recommended to leave the country during this time as if you get denied re-entry for any reason, your application is automatically cancelled. I recommend you reading the first post in this thread, it explains the differences between inland and outland, and the pros and cons.

Your financial situation is not a factor in the sponsorship, you just need to show how you two will support yourselves.

I am a PR card holder citizen of Pakistan I have sponsored my wife currently it is in process I have a Job in Canada now my employer wants me to work for the company outside to Canada (Pakistan) for 2 years. so my question is would it hurt my process or it is fine to live outside Canada if I am working for the Canadian company and after my contract is over I will move back to Canada again.
Please help me on that

Now you need to decide if to apply outland or inland. If your spouse is not in Canada and can not get a visa to go to Canada, you must apply outland. That means that you will send your application to Mississauga and they will approve you as a sponsor. The time that takes is usually 1-2 months to but current processing times can be seen here: http://www.cic.gc.ca/english/information/times/canada/process-in.asp#sponsorship After that, the application is forwarded to your local visa office. If your spouse is residing in a country other than the country of their nationality, you can pick which of the two visa offices you want. Otherwise it will be processed in their country of nationality. You can see the processing times here: http://www.cic.gc.ca/english/information/times/international/05-fc-spouses.asp

If your spouse is staying in Canada as a visitor or on some other visa, you can pick whether you want to apply outland or inland. Outland is generally faster and has appeal rights but a downside to outland is that if an interview is required, your spouse will have to travel to the visa office in the country where it's being processed. Inland has the downside that it's generally not advised that your spouse travels while you are waiting for your processing because it is a requirement of inland that they reside in Canada and if they are denied entry at the border for some reason, your application is gone. If an interview is required for inland, you may also have to wait a long time for it. The inland application would be sent to Vegreville and if all goes well, you would get a first stage approval, usually in 6 to 8 months. The current processing times can be seen here: http://www.cic.gc.ca/english/information/times/canada/process-in.asp#perm_res Then the file is forwarded to your local CIC office where you live and they will contact you for a landing appointment. Getting the PR with inland usually takes 12-18 months. If an interview is required for inland, Vegreville will not give first stage approval but instead will forward the application to the local CIC office without it and you will have to wait for them to have time for your interview. In some cases that can take a year or two. If you do get the first stage approval, your spouse will usually be eligible for health care and an open work permit. It is actually a good idea when applying inland to send an application form for a visit visa extension as well as the open work permit to be given at first stage approval all in one package so it's tied together.

Which method to pick depends on your situation. If your spouses country of nationality has a long processing time or your spouse does not want to have to travel there for a possible interview, then inland is the way to go. For faster processing and freedom of travel during the processing time, outland would be better. Avoiding potential problems with your application

The most common reason for people to be called for an interview is that the visa officer has doubts about the relationship being genuine. It is up to you to send immigration some quality data, emails, chat logs, phone records, photos, letters and other material to prove to them that your relationship is the real thing. Other reasons you might have problems with is eligibility of the sponsor. The sponsor can not be on social assistance, can not be bankrupt and can not have a record of violent crimes or crimes against family members. If that is the case, better talk to a lawyer and get that cleared up before attempting to apply.

Dependent children

If your spouse has dependent children, they must be included in the PR application, even if they are not coming to Canada. They will need to have medicals as well to keep the option open to sponsor them later. The only way that immigration will accept the application without those medicals is if the children are no longer minors and refuse to have it or if the children are in the full custody of their other parent who refuses to make them available for medicals. In that case, your spouse needs to sign a statement stating that they know that they will never be able to sponsor these children to Canada in the future.

Dependent children are classified as single and either under 22 years of age or if they are older, they must have been full time students since before age 22 or dependent on their parent due to a disability or medical problem.

Refusals due to income and medicals

You will be asked to provide information about your income but you will not be denied to sponsor your spouse and dependent children because you do not make enough money. It is possible though that if you make absolutely no money at all that immigration may ask you how you plan to support yourselves.

Spouses and dependent children are also exempt from the clause about excessive demand on health care so you do not have to worry about them being refused for that reason.

Sponsoring your spouse while living in another country

If you are a Canadian citizen, you can sponsor your spouse without being in Canada but you do then have to prove that you are planning on moving to Canada when your spouse gets approved for permanent residency. Such proof can include having arranged jobs, being accepted to college, having arranged housing or letters from friends & relatives stating that they know of your plans and that you can stay with them while you look for housing etc.

If you are a PR, you must reside in Canada in order to sponsor your spouse. You can chance short vacations (remember that a Canadian vacation is generally no longer than 2 weeks) but if immigration finds out that you are not in Canada, you risk getting your application refused.

I have a question when I applied for my husband for sponsorship we put his two children on application we did Medicals for the children as well. The children are not coming to Canada with their father for they live with the mother .we decided to put the children encase they decide later to come . Will this hold up our process . I was excepted for sponsorship but still waiting on Quebec answer also I apply for PR which Kingston has everything except quebecs part thanks

So i shouldn't not worry about that.
But my pasport will be expired on June 2016, are they have enough time for finalized my apps?
And they haven't asked me for photographs.
