There is no specific income requirement to sponsor. You just need to be able to explain why you won't need social assistance.

My advice is to submit a complete application. There are several possible outcomes to submitting an incomplete application:

(1) They will return your application as being incomplete, in which case it will set you back roughly two months.
(2) They will accept your application and give you a file number; you can then forward the police certificates to them
(2)(a) They will not match up your police certificate with your file and ask you to re-do the PCCs. This would set you back 4-6 months
(2)(b) They will review your file, find the PCCs are missing and send you a letter. You tell them you sent them separately and they go look for them. This would set you back 2 months
(2)(c) You win and they match up your PCCs with your file BEFORE the visa officer looks at it

I know you want (2)(c) but my experience is that 2(a) or (b) are far more likely.

The fastest processing is for files that are complete at the time they are submitted. Then when the officer picks up the file, everything is there and they can move it along to finalization.

Good luck, no matter what you decide.

Re: Spousal sponsorship - Option C Printout

Hello All!

First I would like to apologize if I am putting my question in the wrong location. this forum is fantastic and I have been combing through it every day for months now but I have yet to ask my own question. Please let me know if there is another spot that I should be posting this.

My question is this: I am a Canadian Citezen and have been living in the UK since November 2001 under the two year YMS visa. I met my partner here who is Slovakian. We have been living together since February 5th 2012 and are in the process of filling out our common-law FCS visa outland through London. The application makes reference to 'Option C Printout.' It states that I should include one. Am I right in assuming that since we are outside of Canada and have been for the entire duration of our relationship that we do not need to include this?

I'm sorry if this seems like an obvious answer but I am scared to miss anything.

Thank you so much to anyone able to help with this!!!

Apply for it and include it anyway. It is just to show that you haven't been taking welfare in Canada.

Thank you very much Leon! I will take your advice.

May I ask another question? My partner and I are filling out his portion of the forms. We have no dependents and both have jobs so we pay our own way. Where it asks on the Generic Application Form about his family members, does he list me as a dependent. I'm asking because it says that he must list his common-law partner where applicable. am I right in thinking that it is N/A as I am working and he does not support me? Do we list his Mother, Father and brother? they will NEVER be coming to Canada but are they required to be on the form?

Thanks again for any/all help. Very much appreciated!!

Please read your forms and application guides carefully. On the form itself, just underneath where it says "DEPENDANT(S)", it says: "You must provide the following details about each of your family members, whether they will be accompanying you to Canada or not. You must include your spouse or common-law partner, if applicable, and all of your dependent children, and those of your spouse or common-law partner, who are not already permanent residents or citizens of Canada." So, he would not include you on there because you are already a citizen of Canada and he would not include his parents and brother on there because they are neither his spouse or his dependent children. They would however be mentioned on the additional family information form.

Hello everyone,

I'm in a very difficult situation right now. I got my PPR on sept 2012 and did the landing on January. I sponsor my common law spouse but he hash't done the landing yet. And the problem is we just separate, we'll probably be back together but still not sure. My concern is what's the best thing to do in this case? I'm worried that my PPR get cancelled and I don't want him to loose his either.

I hope you can help me,

Mirandaa

You've landed. To remove your status as permanent resident would require a legal process at this point. Assuming your common-law spouse was also granted a PR visa, he can land as well, though he may lose eligibility if the qualifying relationship has ceased to be. Most likely, as long as he kept his mouth shut about the relationship issues and signed the COPR at the border, he'd become a permanent resident as well.

But you won't lose your PR status because of a relationship status change. If he doesn't land by the expiration of the COPR, he will not be able to become a permanent resident and a new application would be required.

Hello computergeek,

Thank you so much for your quick response!

I feel so relieved now. He's been granted with a PPR as well but he hasn't do the landing yet. They gave us until May to do so.
Hopefully everything will be fine.

Have a nice day,
Mirandaa

Hello,

By April of 2013, I will have lived 1 year continuously with my common law partner in Canada. My partner is planning on returning to Japan in April to visit her family. I would prefer to process the application outland so I am using the Application to Sponsor a Member of the Family Class (FC). My question is can I wait to the process the application after she leaves Canada or should I process the application while she is still within Canada to the strengthen the validity of our common law relationship? Even though we would have lived together 1 year continuously, would the application be rejected if we were not living at the same address at the time of submission?

Depending on the route taken above:

Form IMM0008: Question 10: Would the current country of residence be Canada or Japan. If it is Japan would it hurt my common law application?
Thank you in advance for any assistance in this matter.

Temporary breaks in living together are allowed as long as the relationship has not broken down. Thus, you should be fine.

You don't indicate if your sponsor is a Canadian Citizen or not. I do know Japan does not allow dual citizenship, so that your partner is either a Canadian Citizen visiting Japan, or a Japanese Citizen with permanent residency in Canada. If it is the former, then it is easy to demonstrate that she is only in Japan temporarily, since Japan would not permit her to remain indefinitely without some sort of status (e.g., work or student). If it is the latter, then you cannot be sponsored by her when she is not living in Canada. Short vacations (2-3 weeks) are permitted, but if she is gone longer than that period of time and CIC determines she is not in Canada, her sponsorship will be refused.

I hope that helps.

Hi, Can somebody help me please on this question?

I am a canadian citizen and currently live in US. My partner and I flew back to Vancouver in December 2012 and got married there.
I would like to apply her as spouse. My question is, I only filed $10k income as self employed a year and I think I have premium assistance for healthcare.
What is the chance our application get deny because of that?

Thank you in advance
