Thanks for all the replies people. So is this is a new thing or did I misunderstand there being a previous process? And when it says medical received its purely a matching process and not a passed status? I was told by my DMP I would most likely be refused on medical grounds, I believe incorrectly, so it's a stressful time!

So i have everything ready to send to my wife in canada, so almost there , now just missing one thing i dunno how can be done, so i have a Statutory Declaration from friend in english and the criminal record translated, both have to be notarized, but here is the problem, the paper the notary gives and that certifies the translation and the declaration is in portuguese language, they don't give in english, so i have no way to get that in english...unless i translate the notary certification and then then notarize that translation, but will get again a portuguese certication, but at least will be translated...dunno what to do, do they accept the certification of notary in portuguese, or better do another translation like i said?

Thanks all for the help.

If you have not heard from the medical folks and you see "medical results have been received" it means your medical results have "passed" for immigration purposes.

The only reason you would "fail" for spousal medical is if you have a condition that is a threat to public safety or health. Why would the doctor (now "Panel Physician" formerly "Designated Medical Practitioner") say something like that?

Real medical inadmissibility takes over a year just to get through the medical steps, then the fairness steps.

I believe it stipulates that all documents must be in either english or french. So you would have to get a notorized translation. This should be a common occurance since there are quite a few Portuguese in Canada. See if there is a thread for Portuguese applicants or post one yourself. See if that helps.

I'm still stress,I keep checking my ecase everyday to see if the CIC received my medical exam and still not updating yet.I don't want to get at this stage and fail,after all those years of waiting :(.Really stressing us.

Do not rely on ECAS to be up to date.

Hii there...

I have a problem and hoping for some help and advice.

I landed in Canada on 24th October 2012 and today on the 31st January i checked my Application status which says "Complete". does that mean I got my PR Card in my mailing address.

I am totally distressed and badly need to leave the country for some emergency. I need help pleaseeee!!! :eek:

Complete means that you have landed - mine turned "completed" after a few days. If you provided an address when you landed, you should have gotten your card already - I landed 24th of November and got mine yesterday. So maybe you should call the PR card center to see if yours has been sent out or not.
If you're from a visa-exempt country, you can leave without the PR card, no worries.
If you're from a non-visa-exempt country, you can still leave Canada, and either have somebody sending you the card once it reaches your address ( if you call the center and they say that they have sent out your card), OR you can apply for a travel document so you can return to Canada. When I visited my DMP he mentioned the reasons why a spousal application may be delayed, which are diseases that CIC requires to be treated and cured before being approved as a PR, such as active TBD, certain STD's, and other diseases highly contagious (meaning easily contagious) that may pose a high risk (critial or deadly, and perhaps costly to treat) to Canadian population, and non-urgent treatable conditions such as certain types of hernias (as they may be covered by free or discounted health services in Canada); of course, that is not a comprehensive list, but he was clear in that CIC will not usually deny a spousal PR application based on excessive demand conditions such as cancer or HIV, as they are exempt from being deemed as excessive to the health care system under the spousal program (and also because certain treatments will become unavailable to immigrants due to the sponsor's undertaking which applies a "you brake it, you bought it" policy to the sponsor as any health services used, when provided, by the applicant during the term of the undertaking that are deemed as public assistance will be charged back to the sponsor). So, unless you suffer of an EASILY transmitted disease that is NOT treatable/curable and that will likely be a serious health threat to people in Canada, I am surprised you were told that you are medically inadmissible under a spousal application.

A38 has three criteria for rejection: danger to public health, danger to public safety and excessive demand.

I've been through A38 - excessive demand - it's a long, complex, drawn-out process. Further, they focus on only a handful of conditions, the criteria is speculative and entirely cost focused. In my case, the estimated future costs were about 10-15% of what I would have paid over that time in income taxes and while I had both private employer provided insurance and a PHSP (a form of non-discretionary health savings plan) that was enough to pay 5x the potential costs each year they still decided I was inadmissible as a skilled worker. That was the decision I challenged in Federal Court. But I also knew that it would take 12 months to get a decision from the court and if successful, they'd send it back to CIC and I'd get to spend another 18-24 months going through the process again. Hence, why I agreed to settle the issue with CIC by them pushing through my spousal application (for which I was qualified - we'd met before I even applied as an FSW) and me dismissing the judicial review application (leave granted). We discontinued the JR application on the same day they issued the PPR.

Excessive demand does not apply to spousal applicants. They are exempt from excessive demand. The only two things I've heard cause delays are TB and syphilis. The former can take 18-24 months to clear and satisfy CIC. The latter takes treatment and 1-4 months typically to satisfy CIC. I suppose if one had Ebola one would be inadmissible as well, but of course you'd either be over it or dead long before CIC even looked at your file. I've yet to come across anything else that matters.

To be honest, I've never heard of any spousal application being refused on medical grounds. I'm sure it's happened, but it would be exceedingly rare.

Also they send me letter your file has been transfer to Abu Dhabi So, tell me how long they will take and should I call and ask them I heard from people mostly they take 6 to 9 months what u recommend ?

Yeah it really was not a positive experience. I had blood in my urine and then had a talk about final stage renal failure. I was told I would cost too much if that was the case and possibly my actual known health issues (run of the mill stuff like overweight, etc) means I would have to be lucky to be accepted. I didn't want to argue. I had to pay for additional tests and when I questioned those with the receptionist come bill paying time I was told CIC would need to know why I had blood in my urine etc etc. Very disconcerting and really had me worried with lots of sleepless nights.

I knew medical expense was not a reason to deny me but when the doctor says you will probably be rejected you worry what has gone into the report!

I know I don't have syphillis or HIV - they emailed me the blood and urine results.

I agree with your analysis, but nevertheless, if you've got a spouse or child with a medical condition, it makes you nervous!

So the medicals are done and passed, which is good.

According to the CIC website ("My Application" and then "Check Processing Times" then off to the Abu Dhabi listing) the time for 80% is 23 months.

Thus, it sounds like you have a ways to wait. The open data project will have 20%, 30%, 50% and 70% times as well, which may give you a better idea of the time required.

I've actually helped some FSW applicants make it through the medical inadmissibility quagmire - I'm pretty comfortable with it at this point. I'm also perpetually grateful that I'm not embroiled in it any longer.
