Hi everyone,

I am new here and have just created an account. I have been reading a lot thanks to the many great people and their posts. However here is my situation and my confusion.

My fiance and I are currently living in Bolivia. I came here almost a year ago to be with him. I couldn't stand having a skype relationship any longer. I went to school to be able to teach ESL abroad. The whole time I've been here I haven't been able to even obtain a work visa. The school I was working at was corrupt and nothing here was legal by the government. Long story short even when it came time for us to get married here, we couldn't. They send you on this roller coaster ride so the longer your here the more you have to pay in a fine. They would tell me to send my papers here and there and basically wasted my time and money. We have our trip booked for the 18th of December to go home for Christmas. Once we get in the country, if God allows, then we will get married there by city hall and apply for PR visa right away inland, as Bolivia does require a travel visa. (that which I'm working on now.We're waiting for the invitation letter to arrive which my mother sent last week)

My question is this: if we get his travel visa, and while in the country he gets a work visa, would he still be allowed to apply for the PR visa or once the PR visa is applied for, the work visa no longer is valid?

I hope someone can help I'm currently a ball of stress and just want to be home with him and my family for Christmas.

It all depends on the work visa but work visas are valid until a especific date (as opposed to being conditional to an event unless the work visa is limited to a especific employer and the holder of the work visa permanently separates from the job or the work visa is tied to a PR process and a decision on that PR has been reached). I am not sure how you plan to obtain a work visa for your spouse (as they are not so easily handed out). If the Canadian consulate or immigration agent at the airport feel that the Bolivian citizen may have reasons to attempt to stay in Canada - even if by marriage (hint: your mother's invitation hopefully does not say you are engaged) - the visa or entry will most likely be denied.

Work visas still might take a few months to obtain (for which you guys - your uncle - can start the process right away in Canada, you dont need to wait for your future spouse to get to Canada).

You may or may not have issues getting the tourist visa with all of that supporting documentation. You have mentioned that your future spouse is a welder and while in Canada it is paid very well and there may be a shortage of workers with that skill, the case may be the opposite in Bolivia (and the Canadian Consulate will know it), which for his tourist visa may be a problem as that would not exactly make him the perfect candidate to return to Bolivia. For a tourist visa you have to prove that he has ties to Bolivia, not to prove that he has no ties to Canada (or that his ties to Bolivia are stronger than those to Canada). Also, you may be misrepresenting yourselves (by short of promising that he will be going back to Bolivia), which is not good in the eyes of CIC (for future visa processing). What starts bad may end up bad. It is what it is and a catch-22 situation to boot. It seems that PR visas for people residing in Bolivia are processed in Peru and it is currently at 15mo processing time. Even if you were able to get married in Bolivia (which you portray as being a total hassle) your spouse will have a long wait for a PR to be processed.

i just want to know few more things.
i am from india. how can i show proof of funds. can i open a canadian bank account from india and then transfer the funds into it. or else which is the most convenient way to show the funds. and i plan to come back to india after 4 days and i would like to transfer the funds back to india , when i come back.

then what is the winter clothing i should bring to canada. i will be there for 3 days, and i will not travelling out much. should i bring anything from india or should i purchase the clothes from canada just for 3 days. what are the other things i should take care of.

can someone please guide me on these matters

Here is the procedure for opening the account with Scotia Bank in Canada from India.

1. It takes around 3-4 weeks to open/organize.
2. U can send the monies directly to that a/c from your homeland.
3. U get an a/c statement, which suffices for the POF @ the POE.
4. The a/c will be accessible to u 'only' upon landing @ Canada.
5. U have to visit the branch in Canada to 'activate' the a/c.

Since you would be staying for a very short period. It is advisable to carry whatever woolen clothes you have from India. If there is a need to buy a new one, you can always buy it from Canada as per the weather and as per your choice. If you happen to buy new woolen clothes from Canada it will a gift for yourself which you picked from Canada

Assuming you both make it to Canada, do the following:

- get married
- download the necessary forms for your spousal application
- download the necessary forms for his OWP (Open Work Permit) application
- file them both at the same time
- wait patiently for Stage 1 and Stage 2 approvals, and if all goes well, he won't have to return to Bolivia

When you file for a spousal sponsorship inland, it will take you (the sponsor) about 6 months to get approved, and then another year or so for your husband to get his approval. Assuming you (as the spouse) get approved, your husband will then be eligible for a work permit, but during those first six months he won't be able to work legally. So if your uncle wants to pay him in cash as a favour to the two of you, that will be his decision and his risk to take.

This was very popular and probably still is. I think that $10,000 is going to have accrued some serious interest in 20 years, you may well find you are liable for a bill of $50,000+. Upon re-entry in to Canada you might also find that there is a warrant for your arrest. If I was you, first thing I would do is consult with a lawyer who is a financial specialist and find yourself a good accountant.

Technically I guess you can try sponsoring but this $10,000 you stole will crop up pretty quickly.

It's very likely that the lenders long ago wrote off the amount as a bad debt and it won't be an issue for you, but you definitely want to investigate this prior to your return to Canada. Debts can expire (or, at least, become legally uncollectable) when the statute of limitations on them has run (the rules vary from province to province, but I believe the longest statute of limitations in Canada for debt is 6 years), BUT those rules can be tricky when you have left the jurisdiction - the statute can be "tolled", which means it ceases to run during the time while you are outside of the country (but for this to happen they would need to know that you were outside of the country, which they may or may not know). My own guess is that you would be fine, but definitely consult a lawyer (one from the province where you plan to settle), though, as you definitely don't want this to go wrong.

Me and my girlfriend from greenland have been living together since feb 2012 and she recently was forced back home due to her visa expatriation. I want to apply for a sponsorship but dont want to be without her for a whole year to process. is there a Visa that she could apply for to come to Canada so we can apply here together ? I was told that she wouldnt have to leave until its been processed. meaning if shes heere on a visitors visa for 6 months. she wouldnt be forced to leave until the application had been put through. so she would be staying until we get our answer. is this true?

First off - you're not going to qualify under conjugal since you face no immigration barriers. You won't be able to sponsor your girlfriend until you are either married or common law (have lived together for a minimum of one full year). Did you live together for a full year when she was here?

well she was refused to stay in canada thats why we couldnt live together for a year thus allowing us to qualify for conjugal sponsorship. So if she comes to canada and we say get married what would the steps be then?

things to consider her name is on our lease she still pays rent for me and helps with bills. This doesnt Qualify for conjugal?

And if we are engaged or married how would we then apply? if shes living with me under a Visitors visa?

Cause she wants to come back to continue her Career in Make up and special effects for many canadian film companies.
