I would return to Canada as soon as you can. Just because you've been approved as a sponsor doesn't mean you can leave Canada for extended periods of time (you are supposed to remain in Canada until the entire application is approved - not just the sponsor portion). There have been several cases on this forum where the application was refused after the sponsor was approved because they left Canada for an extended period of time and thought they were safe.

I do understand that you're waiting for your husband and son's passports to be returned and appreciate the situation you're in. However what you're doing carries risk.

Ultimately what you do is obviously up to you.

Good luck regardless of what you decide to do.

Agreed. According to immigration rules, you must be residing in Canada in order to sponsor. Now, you can go into splitting hairs about what constitutes residing in Canada but if immigration finds out that you are outside Canada for well over a month and cancels your application, the damage is already done.

hi Leon,.

Ur such a great help for everybody about immigration matter's...Can I asked to get some info to enlighten my mind,!What should we do that my letter didnt come in yet,which our VO email my husband last July 16,2012 that they wil be re sending the letter to me with my new current address, up to now i dont have that letter on my hand,..The letter says that additional docs. and medical instruction..
my question s,Can I redo my medical without that form?or request letter i think..

Just need some help in claryifing a few things
My husband is here in canada with me on a temporary resident visa. We are planning to send in his application for permanent residency in the next weeks as we are planning to stay here and live in canada.. we have a baby and its just better for us to be here. (Im canadian.)
When i send in his application, can i also send with it a application for a open work permit? Does anyone know how long that generally takes until he will receive the work permit?Also do we need to apply for a extenstion for his vistor's visa at the same time we send in his PR application and work permit?

And what about medical and police checks? Does that come later? How does it work if he is from Mexico and we are already here in Canada, do we have to send back to Mexico for the Police checks? If so, does that take a long time??

I have read and reread all the information i can find on this and its just confusing. Really want to get his application filled out correctly and send it off..

Any infor would be appreciated greatly!

If you are applying outland, you cannot apply for an Open Work Permit. You must get the police check from Mexico yes, and the medical can be done in Canada but you must pay for it. As for the visitor's visa, you can apply for an extension whenever, as long as you do it at least 30 days before it expires.

For mexico, there are 2 police certificates your husband needs,
an ssp and a pgr.
the ssp you can get anytime, you can send it in with your initial application or afterwards, but this one you need to get in mexico city, since your husband is in canada, he will have to send a parent or brother or sister with the same last names as him to receive it for him.

the second is the PGR, this one usually you need to wait for them to ask you for it because it needs a specific letter to get, BUT again because he is in mexico city, it is possible to ask the mexico embassy in canada to help you get this certificate on your behalf, without having to go to mexico, or wait for them to request it, but you cannot get it untill after your application has been sent to mexico city for step 2. that being said if you need help with the police certificates come to the MEXICO thread because alot of us are doing the police checks right now or have recently done them with mexican spouses in canada, mexico and the usa. so there will be someone who can help to tell you exactly what to do to get the certificates. (they can get a bit confusing haha )

If you are being sponsored via the inland process then you may apply for a student visa from inside Canada:

The following persons may apply from within Canada:

If you applied via the outland process, you will need to submit the application to the appropriate visa office (e.g., one that provides services for the country that issued your passport). Then when they give you permission, you can file online in Canada to get the actual study permit or you can go to a border POE and obtain your study permit.

With respect to "flag poling" (driving to the border and then entering the CBSA area to process your paperwork) you may do so without a US visa. The US will refuse to grant you entry and you will then be escorted back to the Canadian side of the border.

Hi,
I have been living outside Canada for the last 6 years. I got married to a non-Canadian and got 2 kids (who are Canadians).
We decided to relocate back to Canada as a family and I would obviously need to sponsor my wife in order to get a PR so that we move. In IM5540 of the sponsorship/immigration kit they ask for "proof of intention to re-establish in Canada" such as Job offer, property rental, mortgage, etc.... of which we have none.
So what should I include? there is an "Other" field but what could it be?

Please help.

hello. I've been reading this site for months now, but its only now I find that I'm completely at a loss as to what to do. Please some help or clarification would be great.

I'm currently in Canada with my spouse as a temporary resident (visitor). We applied for the outland application while both of us are still in Canada. I'm being sponsored by my Canadian spouse through the outland commonlaw spousal route. The paperwork has passed stage one spousal approval and is in now in London, UK, awaiting the second stage approval. My spouse will be staying in Canada to work and will not be travelling with me to my home country at any time in the foreseeable future. It was my understanding that when we had applied for the sponsorship visa, that I could leave Canada and return to my home country at any time and 'wait it out', - wait for the visa to be approved. At which time I could move back to Canada with my visa, therfore becoming a permanent resident and getting on with my life with my Canadian spouse.

However I've just been told by a CIC agent:
1. that since I'm only commonlaw and not married;
2. AND since I applied for this outland application while still in Canada;
3. Therefore: while the visa is in process I should not leave Canada until it is approved as it may void/negatively impact my visa application. Basically they're saying I should not leave if I don't want to mess the application up? I thought that that situation only applied to inland spousal applicants.

I really need to return to my home country for personal reasons. But I do not want my application to be rejected solely on grounds that I left Canada before it could be approved.
