I'm going to direct my question at Leo as he seems to be giving straight to the point advise but if anyone else has helpfull advise please post reply also! I appologize in advance for the long story however I need you to understand the situation fully for the most accurate response and help.....thank you in advance.
I have read almost ALL 167 pages of this trying to gather information and allot was helpful while some was confusing.....
I have applied as the sponsor for my husbands PR within Canada (I am a PR living here for 17 years but have applied for citizenship FINALLY and am waiting for my test) - he is currently here with me going crazy as he can not work, study, or visit his family back home until he receives PR. He arrived in Canada October of 2010 and received news his father was hospitalized right before christmas in December of 2010. His father was healthy no sign of any illness when my husband left to come to Canada but suddenly dropped and lost feeling in right side of his body not long after my husband arrived in Canada. My father in law was rushed to the hospital and tests were done it was discovered he had brain tumors, and cancer that had spread throughout his entire body. In other words they gave him only a few months (best guess) of remaining life. My husband and I were engaged at that point, married in February 2011 in Canada. By the point of our marriage doctors were saying his dad could die at any moment. My husband rushed back to at least see him and say good bye - he left beginning of April, stayed two weeks and came right back. We officially applied for my husbands PR in May this year. Unfortunatley my husbands father past away in June and as our application was in process CIC call center agents kept telling us that he CAN NOT leave Canada as the application will be considered canceled. I wish I would have found this thread and comments back then....but I didn't. My husband was not able to be there for his fathers funeral. To make matters worse, when we called CIC in July to find out status of the application they notified us that they LOST our application! We had to send in copies of everything again with new pictures and evidence and send to Team Leader at Case Processing in Vagerville. Finally an update showed up online as received on July 27th and we have not seen an update since.
My dilemma is this:
My husbands mother is now ill and we would like to go visit them for the holidays but we are afraid to leave in case of him being refused entry. This is too much to take! We are afraid and don't know what to do......my husband is visa exempt however upon his re-enterence in April he was granted temporary residence and advised that should he leave again he may not be able to re-enter as a visitor is allowed to be in the country for a maximum of 6 months in a year. He has been in the country now 8 moths and his TRV expires Dec. 31st. (We have applied for an extension). Can he leave on compassionate grounds if so who do we contact - where do we turn to for assistance?
Secondly, I see posts about letters approving sponsors within months of the application being sent in and am now concerned as we haven't received anything yet. We are going on to 7th month of first stage. CIC call centers are of no assistance - can someone PLEASE help! As many, we have also included within the original application, an application for an open work permit for my husband. Is it normal that it has taken this long? When he receives it EVENTUALLY - will this grant him the ability to leave and re-enter?
As he waits for his PR does he have the right for ESL through the immigration program? He would like to better his English but is told he can not study until the PR is approved....If he CAN take ESL does anyone have any recommendations as to where and how much?
As a side note - we are in our late 20s and it is not NORMAL for anyone to lose parents at this age so you can imagine the hardships we are facing with the limitations at hand.....I have a great paying job and a great employer who has offered a job to my husband and has kept it open for him since JULY of this year but he can not do anything prior to first stage approval....
SOMEONE...PLEASE HELP.....My heart is breaking watching him go through this......
