Greetings! This is my very first post and I am excited to learn from all of you. I was born and raised in Canada, met and married my husband after University in the USA and we have lived in New Zealand for the past 5 years. We want to leave NZ and move back to Canada. We are also self-employed online business owners, split 50-50. No children. Is this a pretty basic scenario?

The only "glitch" is that our online business is registered in New Zealand and we want to keep it in NZ. Will this be an issue for Canadian immigration?

I am so excited at the prospect of moving back to my beautiful home country of Canada! It has been 16 years and home is calling to me! Looking forward to chatting with others on the forum. Grin

Being married for some years, it should be pretty straight forward. The only problem is that if you apply from outside Canada, you would have to prove your intention to settle when your husband gets his PR. To avoid that, you could come to Canada together. Officially you would be the one moving and he is "visiting". I am assuming that your husband is visa exempt to Canada. If that is the case, there would be no problem. You can then apply to sponsor him without needing any proof of returning to Canada because you are already in Canada and he can stay with you as a visitor, extending if he wants to stay longer than 6 months.

Thanks Leon, and nice to "meet" you! We could definitely come to Canada together, I just worried about him visiting on the usual 6 month visitor visa that Americans get (correct?) and then Immigration not being happy about him "visiting" there while his application is still not approved.

Does immigration care where he lives while his application is being processed? Being an American, can he leave and come back without problem?

He is not allowed to officially move to Canada until he gets his PR but he is allowed to visit. If you apply outland, that is, you pick the applications forms to sponsor a member of the family class for a spouse who is living outside Canada, then he can come and go as he pleases.

Extensions are usually granted when you are sponsoring your spouse but he would need proof of when he entered if that is the case. When entering Canada, you can state you want to sponsor him and ask for a visitor record. Immigration may allow him to stay for up to a year then.

If you are inside Canada, you are making a "privacy act" request (no fee). If you are outside Canada, someone who is inside Canada must order them on your behalf ("access to information") and you must provide them with a form permitting the disclosure as well as pay a $5 fee.

I m a canadian by birth but i live exclusively out of canada. I sponsored my husband in march 2013, last heard from CiC in April 2013 that the file has bewn sent to ISB Cic office pakistan.
is it possible to get rejected?
once my hubby gets the PR, we plan to move to canada. We also have a kid whose a year old n canadian by birth...

In Pakistan, it will probably take a couple of years just for the processing but it is possible to get rejected if they do not feel satisfied that you intend to move to Canada when he gets his PR, if they are unsure that the marriage is genuine or if your husband does not pass background checks.

So it wudnt matter if i go n start living in canada n try to get a job n get my kid into school and healthcard, SIN card?? Will it make thm believe that we do intend to live thr once my hubby getd his PR?

If you are residing in Canada, you don't need to prove intent

I am aware of that.

I don't know that it's much use doing it AFTER you have already submitted the application because you should have already provided proof with the application forms.

I suspect that the VO will see it as a cynical attempt to meet the requirements when you have no real intention of staying after PR is granted. How will you convince him if he doesn't believe you? Will you be giving up a well paid job to return to Canada?

If you move to Canada, you would update your info with immigration and if they check up on you and find that you are working and your kid is in school, they would not need proof that you are intending to move to Canada because you already did. However, because the application in Pakistan takes forever, you'd be separated from your spouse for a long time if you do that.

It is not necessary for a Canadian citizen to return to Canada while waiting for her husband when he gets his PR. However, VO must be assured that the family really intend to go to live in Canada after he getting his PR.
If the wife has never lived in Canada how she can prove that? Only by going to live in Canada, IMHO.

When i submitted my application in march 2013, i didnot give them actual proof, i just wrote that i'll b doing teaching courses n my husband will b doing IT courses so we get good jobs thr once we come to canada and i also wrote that my brother n cousins live thr who'll help us out in initial stage..
The last i heard from them was in april 2013, telling me that they have taken a decision on my(sponsor) eligibility and that decision is sent to me via letter. But i didnot receive any letter from thm uptil now. They evn told me that the file has been sent to ISB cic office,
i emailed thm twice telling them that i didnot receive any letter but no reply from thm.
