When responding to the questions on the form regarding to the visas refusals, I explained the reasons why I applied and why I applied for the work visa as well. My case was all well documented in a way it all makes sense so I guess I should not worry about that, although it is hard not to once it's our lives that are in that application, but my conscience tells me I've done it all right.

Hi

I am a Canadian Citizen married to a UK citizen Living in England. we have been married for two years - married in Alberta. I just found out I can get my job back in Canada which will start Mid June. I don't want to be apart from my husband for very long and in turn he doen't want to be with out a job for too long.
According to the CIC processing time website
if we apply for an outland sponsorship stage 1 will take 28 days - -- question--- after Stage 1 can my husband join me in canada and apply for an open Visa and come work in Canada while stage 2 is still in progress? or does he need to be in the UK?

If we apply for an inland sponsorship: 1. if he travels with me (I have a guaranteed letter of employment) can he get an open work visa at the canadian border? CIC website "If you are authorized to work in Canada, your accompanying family members may also be able to work in this country by virtue of the permit you were issued. No other authorization is required. If they intend to work while in Canada, your accompanying family members should find out if they are eligible for an “open” work permit. " or is this just for foreign workers?

2. inland application for stage 1 takes 6 months - but I've been reading other posts where stage 1 is processed after 2 months - is that true?

What should we do? any recommendations.

if we do an inland application should he get a medical done in the UK?
how long does it take to do the application?

you can use both of them as they are asking the name on the passport too. but its better you use your husband's last name as your last name. bcoz otherwise, it'll be a problem later and they will suspect why u dont use your husband's name after marriage. (it caused me too).
and also its better and easy for u to fill the application on the computer(adobe). then u can see, for some questions there are option answers to choose.
and i suggest you to keep the guide close by on the computer when you fill it. one by one u can realize what answers you should give for the questions.
and keep this in your mind thoroughly,
collect your all the evidence with your husband and send them. after apply also dont throw the evidence ((communication )phone detail sheets/ skype detail sheets/ greeting cards / letters/ fb print outs/ emails & asy other documents ect.) & collect them all & keep. they will ask them later definitely.

With an outland application, your husband can visit Canada at any time. He would just travel on his visa-exempt passport, and a typical visitor visa in this case is for 6 months time. After that he could return back to UK, or try to extend the visitor visa to stay longer.

No. This is only for foreign workers. If he is applying outland, he could also try to apply for a work permit while in the UK, but this will be completely separate from the PR application.

You should read the threads dedicated to inland applicants, to see current times.

Keep in mind with inland, you are not recommended to leave Canada at all during the entire processing (around 1 year or so). If for any reason he left Canada and was not able to re-enter... the entire inland application would be terminated.

If you are doing inland than he will be in Canada anyways before you submit the application, so in this case you should get the medical in Canada. Medicals should always be done as close as possible to submitting the application.

It is up to the CIC agent to determine if it is suspicious that your sister lives in Canada and you met a Canadian a year after a TRV for Canada was denied. However, I would not worry about it as long as you have documentation of a strong conjugal relationship with your husband. Visa denials may not be that consequential to your application.

Processing time frames depend on the Visa Office that will handle your case, which will be determined by CPC-M based on your place of residence (if you are outside Canada) or citizenship (if you are in Canada applying outland).

you stated he could visit canada after stage 1 (with outland apps stage 1 currently 28 days)- and even get a work permit. With the work permit, will it be an open work permit? or will he need to find employment before hand within canada, where the employer need to do up a LMO?

and lets say he comes for a 6 month visit after stage 1 is approved - will stage 2 require him to go back to the Uk for any reason regarding the PR application? for example in stage 2 will he need to be in the Uk for any appointment if the immigration office requires?

with Inland applications is he able to work once stage 1 is approved? - I think the answer is yes but can you confirm?

As a visa-exempt passport holder he can basically visit Canada anytime. Doesn't matter if before stage 1, during stage 1 or after stage 1. Anytime.

For an outland application any work permit you get is completely separate from the PR app. He would have to qualify for a work permit on his own, either by getting a job offer and LMO from a company here... or applying for some other work permit that UK citizens may be eligible for. Again, this has absolutely nothing to do with the outland PR app.

The only reason he would have to go back to UK, is if an interview is required. In most cases interviews are waived, it's only if you have lots of red flags in your application would the VO be suspicious and request an interview. If you've been married 2 years already, you will most likely not need any interview.

Yes, if you apply for OWP along with your application, he can receive it once stage 1 is completed for inland.

hello guys,i need help...... i am international student. i got married to my fiancee in the USA last year December. she is an american citizen but stop college because of family frustration.(may not qualify for NAFTA program). living apart has been painful for both of us. now we are both planning for her to come and live with me here temporary until we both figure out how she can go back to school and complete it (nursing program). i have not change my statues yet to married. since she does not need a TRV to visit me here, i was wondering if she can go ahead and apply for open work permit once she comes for a visit. do i need to change my statues at the school and with cic too as married? or the marriage document will be enough prove? finally what would be the best advice here. she has already tried the job search but no employer willing to give her an offer based on the fact that she does not have a work permit or legal status in Canada.

It was so easy to apply for a spousal visa to stay in the UK, it took less than a month (financially Uk isn't that great for us)- isn't there something similar for canada? I'm not sure why it takes soooo long to be able to stay in Canada.

For a visa-exempt applicant and straightforward case like yours, in my opinion I would do outland through the London visa office. In many cases the entire PR application can be approved and you can have PR status, in around the same time it takes to just get stage 1 approval with inland. There is practically no chance you will need to go for an interview in UK if you do the application properly. And also by applying outland he is free to travel in and out of Canada as needed.

Unfortunately there is no "spousal visa". For Canada, basically the equivalent of this is to apply inland in which case you have implied status and can stay in the country (but can't leave) during entire processing time.

Are you able to send more proof of a continuing relationship after you submit your spousal application.

we're in a situation where we didn't use to take a lot of pictures. We do have lots of supporting letters from family and friends, travel itineraries, hotel stays, paying for each other's tickets, gifts, receipts etc. But not many loving photos =P but these were pre-marriage, when we were in a relationship. usually when we go out we take pictures of the places we are going to, may be of each other but not together. Its me taking her's and her taking mine kinda thing. Yeah, we're a bit bad like that. didn't do a lot of photos together.

I only sent in 11 including wedding pictures. One was my husband WITH THE CAT. I literally sent in every picture we had plus 3 from the wedding. We don't do pictures. I have a camera and like taking pictures...... of nature........ (The cat is totally our baby... we're lame like that.)

Don't worry about the amount of pictures. It's the quality that counts.

To answer your question, yes you can. Send it after you know your file is transferred. There is always a chance they won't two and two together - make sure to include all useful information - Sponsor Name, DOB, UCI, Applicant Name, DOB, UCI, Application Number, Address, etc.

you should definitely have all the proofs after you applied too. you should get photos with ur partner to show up ur relationship is very loverble & also you are very comfortable with each other.
& also you should collect all the proof of communication like phone detail sheets, skype detail sheets, fb pictures (of your posts & sharing & comments to each other's pictures), greeting cards, letters etc. they'll definitely ask them in later time.
