Thanks,

Where would I include a divorce certificate from my spouses previous marrage?
Include it with your spouses application. There is a question that asks if there were prior marriages. List the prior marriage info and divorce date then place the divorce certificate after that form.

Is the medical required immediately in the package? or will they ask for it later? I'm worried about holding off for it because the police certificates will expire in 3 months. Can I send it in later?

Can I send photos of our marriage and relationship in an album? It says keeps photos loose, anyone else experience this?

I am US so my medical was upfront, meaning it had to be done first and included in packet. You will need to look at the instructions for her country to know. I can't tell from your post where she is from.

Photos can't be in albums. I put mine loose in a small envelope.

She's from Honduras, she called the specifying medical location in her city and they told her it was done through the computer and it had to be requested from here with some Identification Number. I looked at the Latin American Guide and it says it's included in the package. So, I don't know who's right and who's wrong. I heard it was optional to include now or when requested. I'm really confused.

You need to explain to hem that it is an outland and upfront medical . Yes it is done through the computer with is called efile . You will need to set up an appointment have an xray and blood tests and a medical . Then the Panel Dr will email the results to CIC and you will include the receipt in your package you send off. Make sure you keep a copy. UPFRONT MEDICAL .. this is the terms you have to use.

What happens if I didn't include the Upfront Medical in the package?

Another question, my wife has a son from a previous marriage. Do I need to include anything in the package like a permission from his father to let his son leave the country?

For an Outland application, it is strongly suggested that you complete the upfront medical, else you risk your entire application being returned as `incomplete'. Just follow the instructions that taffy7 has provided. Also, make sure that she uses an approved Panel physician (listed on CIC's website) and that the doctor uses the e-medical system to transmit the results to CIC electronically.

Regarding your second question; are you also sponsoring her son at this time, or is he being listed in her application as a non-accompanying dependant child? Even if he is not coming with her, he will need to have a medical exam too. If he is being sponsored (which it sounds like he is, since you're asking if he can leave his country), then she will absolutely need the father's written permission for the son to leave (unless he has forfeited his paternal rights).

I'm sponsoring them both, she has her son listed as a dependent coming with her, does IMM 5604 apply in this case?

Hi.
I have a question.I am a PR of Canada , landed on 8th sept 2015.My Boyfriend already lives in Canada on work permit. We got married on 10th September in Canada itself.
Now we have to file his PR wherein I will be sponsoring him as a spouse. But the problem is I have to go back to India to resign from my current job and have to serve a notice period of 3 months over there which is mandatory.

So anyone, please suggest me what to do, as my consultant tells me that there will be no problem if I visit India for 3 to 4 months after applying for the Spousal PR for my husband. But I want to be sure that my visiting India for 4 months will not create any type of problem for our PR application. Please guide me.I am in a real dilemma.

Thanks

Your consultant is mistaken.

Since you are a PR (NOT a Canadian citizen), you must continue to live in Canada the entire time your husband's PR application is being processed. You could leave temporarily (for a couple of weeks), but leaving for 3 months is a huge risk for you both! You would be advised to wait until you have returned from your 3 month visit and then apply for his PR sponsorship.

Prior to you landing, had you and your [then boyfriend] lived together in Canada? If so, for how long?

Hi.Thanks a lot for your reply.
No, we were in a relationship for the last 5 year but we have not lived together either in India or Canada.

That's good! More than a few couples have made a tragic mistake by living together for at least a year (anywhere) prior to one of them landing as a PR as a single person...not knowing (or admitting) that they were really a Common-Law couple. The tragedy is that the person could NEVER sponsor their partner/spouse and their own PR could be in jeopardy on the grounds of misrepresentation.
