Spousal Sponsorship Question

Hi Everybody


I posted a few months ago regarding my sister getting married to someone living in the US, who is an illegal alien. We're ready to move forward with the process, and we are going to be working with the Cohen law firm for the process. However, every time we start the process new questions keep arising, and I just want to be sure before we start putting money towards something that may not happen.

My question is simple. In the application process, an FBI check is required. My brother in law is an illegal alien, does anyone know if getting an FBI check will be an issue for him (e.g. will he be found, and deported, etc...)?

Of course I understand this all depends on the current situation in the US but I would like to know so if worst comes to worst, we will force him to go back to his country, and apply for his sponsorship from there.

My other question is does a previous immigration record such as his (he was on a F1 student visa and quit school) affect his sponsorship application? Would the record in anyway play a role in his rejection or on the application as whole?

He can and has to apply PCC from FBI, and it won't be an issue at all to lead him to be found/deported. He needs to be 100% honest to include all his immigration history on the application, and no, it won't play a major roll in the spousal sponsorship. But you guys need to be prepared that he may be requested for an interview, which means you needs to leave US to attend the interview at the VO of his country of Origin.

Hi. Thank you for your response. Yes we are aware that he might have to leave if an interview is required. I would just like to know what PCC is, as I am not familiar with the term? Thank you again.

hello , my sister is in the same situation right now my sister married someone in the USA who is illegal and will be applying for sponsorship in Canada. Unfortunately he was arrested recently for not paying a transit ticket, he still in the USA and plans to stay there until he needs to go for interview , how can this affect his application for sponsorship? thank you for your help
