Spousal sponsorship - Need advice on Additional Family Information - marital status of spouse's parents

Hello all ppl from this community.


I am currently a PR. My details are as below

Me: Primary Applicant
Spouse: Non Accompanying Spouse
Child: Non Accompanying Child

My spouse's mother and father have not been living together since 15 years and we don't know father's whereabouts. The spouse's family also didn't try to find him as they did not want to keep any relations with him. But legally, the couple is still not separated or divorced.

In the IMM 5406 family information form of my spouse, I have mentioned "Married" for the Father and Mother. The current address is also the one where my spouse's family (Mother and spouse's brother) stays because there wasn't any legal separation/divorce.

Now, I am planning to sponsor my spouse for PR. However, her father was not present at the wedding because of the reasons mentioned above. We will have to mention this in the PR application for spouse - for the question related to whether both parents were present or not. We are planning to get a letter from the court regarding the separation and update the address as unknown. in the new IMM 5406 which my spouse will submit.

Will this amount to misrepresentation as far as my PR is concerned? Please need your inputs as this is really taking the peace of mind away from me.

What are the alternatives for me as far as informing CIC is concerned.

Pls help me!!!!!

I would put unknown as address and include a letter of explanation that no contact for fifteen years, whereabouts unknown.

I assume you mean his address is an official address - you can explain that briefly. Ircc generally wants actual residence not official but in some countries all documents will show official.

Yes, its official address as that would have been his address had he stayed with tge family. Since spouse's mother and father are not legally divorced or separated, i put the official address.

Up to you. I would out address unknown in the form and include letter of explanation. In letter you can state official address is unchanged but whereabouts unknown.

Thanks a lot, and one more query - I had made a typo when entering The DOB of spouse's father in my EE profile. But, later on I was asked to submit the IMM 5406 and IMM0008 forms by uploading it to my profile. This time, I entered the right DOB. My PR application is approved now.

When I apply for my spouse's PR, does IRCC refer to the EE profile (DOB with typo) OR the IMM 5406 family information form which I had uploaded again? Have they missed my typo or I should inform them in my spouse's application with a letter of explanation.

It won't hurt to include a letter of explanation that the original EE had a typo, just in case the discrepancy is noticed.
