Spousal Sponsorship- Ireland question

Hi,

I have been thinking about sponsoring my partner who currently lives in Ireland, I was wondering if anyone knows how long outland sponsorship takes through the London office. Aslo, how long can I visit him while sponsoring as a PR?

I would go the inland route if possible, however processing times have gone up for an OWP and processing in general. Any advice? he is over 35, so no International Experience visa, only visit visas are applicable unless I am missing something.

Any advice?

Thanks!

Standard processing time is 12 months - that doesn't count the time to prepare your application which can take months in between certificates, photos and other necessary information. Are you married, or can you prove a common-law/conjugal relationship?

No IEC visa - he lost his chance due to age.

Up to you to bring him inland, you'll have to be very mindful that when he gets to the border the CBSA will be asking very tough questions about why he's here and how he can support himself.

Hi,

Thanks for the reply, I have since edited it to it being the London office, I know some take longer than others. It is good to know that it is still 12 months or so after applying.

We are currently in a conjugal relationship, so this is more so just to get a better understanding of what can be done once applicable.

Thank you!

Uh oh!

Unless there are any true immigration barriers preventing you from getting married, or living together for 12 months or more, a conjugal application will fail. He could come to Canada to visit (if approved) and extend the visitor visa to reach the 12 month cohabiting together requirement to then apply as your common-law partner. Yes, it would be inconvenient for him/you, because he would be unable to work in Canada or have health care, but that in and of itself does not qualify for valid reasons to apply via a conjugal sponsorship.

Fastest option would be for you to travel to get married (in-person, since IRCC does not recognize a proxy marriage) and then submit the Outland application when you return, while he waits in Ireland.

That is what I was thinking, was just wondering how long the outland processing time takes through the London Visa office, and if I can go for longer visits while waiting (I know there was a link to that somewhere at least in the past).

I would definitely not go the conjugal route, in this case. That is only our current situation.

Thanks for your help, everything you said is essentially my experience/thoughts in general.

Just want to suggest you remove `Conjugal' from your vocabulary, in terms of your relationship.

You are, like many, in a long distance relationship. ;)

There is a chance that IRCC will go on strike soon, which can only add to the delays...of pretty much everything.

Last Question:

It says that Processing times for an initial work permit from inside Canada is 146 days online or 17 days if requested on paper, I am a bit confused. How long does it take to process and average OWP upon application with all the other documents?

That doesn't apply to a spousal sponsorship OWP.

Things changed (for the better?) last September. Now, all spousal sponsorship applications must be made online and the OWP cannot even be applied for (also online only) until the Inland sponsorship `AOR' (Acknowledgement of Receipt) email has been received, simply showing that the sponsorship application has been received. Only then can an Inland applicant submit the OWP...and wait for it to be processed.

Oh, I had no idea, and how long does that usually take for now from the AOR to be processed? Thank you for letting me know, it has been a while.

May I ask, is your concern him not being able to work if he arrives and applies inland? Or time together? Or both?

Lately inland are supposedly going much more quickly than outland - but I don't follow, don't know. So quickly that the OWP is of questionable value (I mean, if an inland takes 8 months total and you get the OWP after 7 months, does it matter? A bit, I guess, but not so much).

If you're just trying to decide which balance of time together/out of work/etc- only you can decide. Any times people give you are either estimates based on the trackjer, or guesses, and won't help after the fact.

As far as you visiting - sure, visit. Just don't move there. If you want a rough guideline, vists of less than a month at a time should be fine. If you're trying to save money, that's probbly about max of what most people could afford eg two visits of a month each.

Hey,

Yea, mostly just trying to gauge how long he would be out of work for here, I know that it is all just an estimate. Unfortunately in case of an inland application, not being able to work for many months ( most of the time) would be in issue.

Outland would be doable, if you know of time estimates for processing in general these days, especially the London VO that would be amazing. Ideally we would just really like to be together as soon as possible, within reason of course.

He could work remotely (via the internet, phone, etc.) for a company or individual that is not in Canada, nor has a presence in Canada. He would also need to be remunerated from outside of Canada. This would not require a work permit.
Wonky, yes...but doable.

How long have the two of you been in a relationship? Is marriage even an option right now? If its is, you could visit him...get married...you return to Canada and submit an Outland application. He gets to stay put and continue to work, whilst waiting for the PR application to be approved.

Lol I like your train of thought, we have been together for a little over a year, known each other for 5. Marriage could definitely be an option, as I love him very much. How long does outland processing time takes these days on average if married? Thanks for all your help.

Nobody can really say with any level of certainty how long an Outland takes, or even which office [exactly] would process it. London seems logical for you two, but it's always up to IRCC to do something different.

I would suspect that the process time to assess a marriage, would be shorter (and easier for you) because you do not need to provide living together for one year or more, like a common law couple does, so that would eliminate at least part of the you and IRCC. Check some of the Outland threads here (some have spreadsheets) to get some ideas.

Here's one:
