Prepare well enough for the interview. Talk about any red flag with your spouse. And gather more documents to prove your relationship is genuine. You can browse through Hasan9999's first post and read the questions usually asked. Actually, an interview is good; it gives you a chance to convice the officer that you are being genuine with your relationship. Also there are people who were scheduled for interview and after sending more proofs, the interview was waived and the officer seemed satisfied.

Good luck!! Keep it positive!
Thank you so much prvc. I will take as much information with me as possible at the interview. I am so scared but i have a month to prepare.

I will post here if i have any questions.

My husband and I are both divorcees. He has 2 children who live with his ex wife. I lived with him in Canada on visitors for 9 month before i returned to Fiji.

And then had his divorce and we got married 2 months after his divorce. Is that a red flag? When i was living with him, i also wasn't divorced and had it finalized after returning to Fiji. I feel that is a red flag on our application because we provided a lot of information to prove that our marriage is genuine.

Farhana and HAssan please assist me with preparing my application. My husband visited me three times after I returned to Fiji. My husband is 5 years younger than me.

I am not good at interviews, even at job interviews i start mumbling, already so scared.

That might be why they want an interview. From my interpretation, that could mean you are not a member of the family class.

See IRPA Regulation 117(9)(c)(i) here: http://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/page-26.html#h-77 . Also 125(1)(c)(i) : http://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/page-27.html#h-78

Again, this is just my interpretation of that regulation.... I will defer to anyone else who can shed light on it...

Hi AARCEE,

As others said, one month is more than enough to prepare well for the interview. But a tough interview is anticipated given your situation. You have to win this tough interview to avoid time consuming appeal process and uncertainty.

Your story is somewhat different from others and that's why you have to address all the red flags very effectively to prove that your relationship is 100% genuine, no marriage of convenience is taking place.

I don't know whether you guys have cohabited for a reasonable period or not. This point is crucial. Is it possible to stay together until forthcoming interview?

Prepare all possible answers with your full satisfaction supported by comprehensive documentation as per checklist.

All answers must match with the answers of your spouse whatever insignificant may be...

Have mock video interview everyday with all possible tough answers...correct the way you answer....your gestures...your body language....

Be specific...avoid giving extended and unnecessary answers.

Concentrate gathering enough and solid documentation proofs to substantiate your application.

Good luck!

Hasan

It is not clear in your post and Profiler is already pointing towards the possibility of not being family class so I will ask, we're you both divorced- finalized and everything- before you married?

I think they were living together (common law) but at the same time they both were still married, will that be an issue? will this time as common law will count as a legal relationship?

I suspect that is what the VO wants clarification on. The problem here is, depending on where they married (and the laws in that land), if she didn't declare that she was married, that might be a problem. Usually, at least in Ontario, you have to provide a divorce certificate (if you are married) to be issued a marriage license. This said, you are prevented from marrying until that is complete. So, if she were legally separated, it should count as common-law, but she cannot marry another until the previous marriage is finalized.

You can be married to one person and in a common law relationship with someone else provided that the marriage had broken down and you were separated from your married spouse.

The issue would arise if when they got married is one or both were still legally married to their estranged spouses.

Yes, everything was finalized before we got married. We both had divorce certificates before as got married. After we both had our divorce that's when we got married.

Thank you Hassan,

We lived together for 9 months in Canada before i returned to Fiji. We both are legally divorced and now legally married to each other.

After I returned, he came to visit me for 10 days, then again for three weeks - that's when we got married. He again came to visit me in August this year for 10 days.

I provided all the proofs when i did my application. I included every little detail of our relationship. I am planning to collect all evidences after our marriage and take with me to the interview.

Hi everybody ... Have another question... Let s say I have our old e mails, but the Buber messages after I change card are gone .. But still have all pic from the time between ... Is that a problem! Will they be interested in only conversation between two of us or check every other conversation I had, I don t really want them do read all my personal messages with my husband they are private or with some other conversation with my friends???
Should I just send the one they are not private private ? :)
Hello snowflake4789,

To me in the immigration interview process there is no personal. In my 9 months’ experience, I find out if you want to get your visa it is wise to respect them and if they want to see your personal message you should give them all your personal message.

For example, in the interview day the applicant brings skype, viber and other app personal conversation and call list as a proof of their marriage. If an applicant does not feel hesitate that time to keep with it and show the immigration officer in this situation if immigration officer want to check an applicant mobile or Facebook personal conversation I think it is not wrong. It gives you an opportunity to proof your marriage is genuine. I think you should not hesitate to show your personal message.

Regards
Farhana
