Spousal sponsorship inland or outlans

Hi if I can get any suggestions or help on my situation would be appreciated! I have been married to my husband for 5 years and we have 2 children together I am a born Canadian citizen my husband came here on a student visa we married and it has now expired, I want to sponsor him from Outland while he is living here in canada with me but I'm not sure if I can because of his expired visa? Any suggestions? He does not want to leave me or the children. And we want the faster way of approval his visa office is Abu-dhabi, thanks for your help!

Hello Zakmalik, I will try to answer your question but my info. may not be up to date so please keep that in mind. You could sponsor your husband outland while he is living here but as far as I know he does have to be "in status". That is the part you may need some more advice on. He could leave Canada and return but that is a risk as he may be refused entry on his way back into Canada due to his expired visa. If you do not get any other definitive answers here on the forum then you could contact an immigration lawyer for advice. Many of them will do a free consultation or it may be worth it to pay for 30-60 minutes of their time so that they could guide you as the best steps to take.

There are also some senior members on this forum that you could send a personal message (PM) to and that may be a more effective way of getting an answer. The people that come to mind off the top of my head are - PMM, Leon and Scylla. You can search for them by their member name. Hope this helps a bit. Blessings.

Thank you for your help I thought that was the case we will just apply inland, he has been out of status longer then the 90days to apply to redo his visa, could I ask how important the option c printout is? I haven't worked this year and i don't have anything to claim on taxes and his family back home sends us money to support us we have receipts is this enough evidence ? I am currently looking for a job in my field to help support us also if he is granted PR he will start to look for work immediately

IF you have been in Canada you still have to be FILING taxes, even if you haven't worked. I assume you have done that?

I have Nothing to claim this year and i was told since I have zero to claim
That is ok? My question was do I NEED an option C printout or not? I am plannig to send out our application immediately so If I absolutely need one I will go file and wait another few weeks for an option c?

I did not include any option C printouts when I applied to sponsor. I did include a note explaining why and I was approved without any issues. I even ordered my notes and it was not mentioned anywhere.

Actually, IIRC, there's a space on the form to list reasons why you're not including them.

Yes to both. You should include as much information as possible that will show you will not be able to live without using welfare.

Don't worry about it. Once you submit the app, there isn't a way to update your file until you get your UCI, which you'll likely get when you get SA. If they have a problem with your situation, they'll let you know and then you can tell them about your new job.

since my husband is out of status and over the 90day limit to re-apply would I be able to apply Outland for him and he can leave canada shortly after I apply? He is from Yemen and there are no access to airports or flights in and out right now of that country we need to send the application as soon as possible let me stress we have 2 children together and him leaving is not something he wants to do but we are looking for the fastest processing times, he has been away from
His family for almost 7 years (he was here studying on canada) and talks to them daily on the phone but god forbid sometning would happen to them during the inland application he would not be able to leave to see them
During those 2 years processing time that is another reason we are leaning towards Outland.
