Dec 2, 2016 applicant, went out of status Nov 10, 2016 - just got this from MP

  • The application was received at the Case Processing Centre in Mississauga (CPC-M), Ontario on December 2, 2016.
  • The initial assessment to ensure your constituent meets the eligibility criteria and that the application is complete, is still in process.
  • The medical examination results have not been initiated. The office will contact your constituent’s spouse with further instructions.
  • The criminality verifications are currently in process.
  • The security verifications are currently in process.
  • As per our current processing times, it may take up to 26 months to finalize the application. However, processing times indicated on our website are approximate, and can vary with each individual case.
  • If the application is approved:
    • the officer will send an approval letter to your constituent’s spouse to advise that they will be contacted by the local office with an appointment for the final determination interview (to grant permanent resident status).
  • If the application is refused:
    • the officer will send your constituent’s spouse a refusal letter, and
    • a copy of the refusal letter will also be sent to your constituent including instructions to obtain a refund of the Right of Permanent Residence Fee, if it was already paid.
Sounds normal to me. You will still see the eligibility assessment in progress until late November or Early December at present processing times.

Hello kandyk,
I'm happy u landed. If i don get wrong i read somewhere that u claim refugee and at same time u had been filed inland sponsorship. If so i do same procedure and appln but ntg yet. My question is the claim does affect the sponsorship appln? Intermes of time and crediblity...etc
i am a kind of worried right now. pls provide detail info and opinon.

I hv hearing next week and i am not going to win due to many reason and will be out of status after 1 year approximately. And do u think rejection also affect the sponsorship process?

Hi as far as i know being a refugee does not interfere with sponsorship application. However like masha said, see if your lawyer can postpone the date until u receive at least aip. Im not sure what they reason are, or why you think you may not win. But if the lawyer cant give you a later date, i would suggest that you go to the hearing anyway. If its a positive outcome, great! If negative, you can contact CBSA to let them know that you have an inland sponsorship in process and u will like to stay here until at least a decison is made on that. Im not sure how the process is for that but you can find that out.
Hopefully that go well if refugee fails. If it doesn't then you may need to leave Canada and apply for sponsorship again outland.

As I suggested before, the process is called an administrative deferral. That way the refugee claim that will fail can be dropped. It should be noted, a failed refugee claim does not bode well for any future applications....

Thank you guys,
I advised my lawyer abt postponding my hearing he said they wont exteend anymore its been extended morethan a yr and adviced him abt the defferal admin. And he said ma situation is a bit complicated that i wl be out of status since signing/reporting every month at CBSA as a result of been addmisablity hearing which i won.

As. I said earlier i hv zero chance of winning ma hearing but i have at least one year by appeling before i go out of status and i wonder one yr is good enough to go through the whole process and independet ?

Salaam masouleht, Criminality is simple, this is whether you committed crimes or not. So, already with the police clearance they have a very good idea. However, security is much deeper, this is to check if you are suspected to participate in terrorism or in group trying to overthrow a government, and so on. The security checks are made by CSIS and their foreign intelligence service partners.
At least, this is my understanding. Maybe @profiler could add/correct.
Then as you are from Iran, this is where it can take longer as there is no (known) cooperation between Canada and Iran.

any idea for countries like IRAN, how long does that take normally?

Same day, I would be surprised, but it also depends on your location.

I wouldn't be surprised if there is a physician in Toronto that might have a same-day (via cancellation or what have you). But, I agree, highly unlikely as this is not considered an "urgent" service.
