Hello,

My name is Evan, and I'm honestly quite exhausted with researching and getting menial results with the internet. We have many questions, and we hope you can help us.

I guess we should start by telling you about us.

Me and Mindy met about 2 years ago online and formed a relationship rather quickly. Within a few months we were on skype every day with one another for hours at a time. This past year I began making trips to Canada when I could take time off work. We started discussing Immigration to the US, which is when we discovered Mindy had become pregnant... :eek: I made a very silly mistake, I quit my job, I sold alot of my stuff, and drove to Canada without doing any research about the immigration process. I moved in with her thinking it would be easy, fast, ect. Soon I would find that I was wrong. We discovered it would be faster for us to be together if we got married and I immigrated to Canada, so that's what we decided. We want to one day move to the US though.

At the time I'm writing this I've been in Canada for about 3 months. I planned on returning home last week to start work again in order to help pay these immigration fees, unfortunately I became ill and my car broke down. Now that I'm getting better the time for the birth date is looming closer and closer, and I'm still not any closer to being able to work and help support my family in Canada. We're both very worried, there's been a lot of emotional stress on us both.

My plan now is to return home and work until I can pay for the process and help support us for a short while until I can work and support us in Canada. Neither of us have much money, so this has been pretty rough. Luckily my family has offered to help support us in every way they can.

So that's a little bit about us, and the situation we are in, now for my questions.

1) I understand that applying outland is faster for getting me to permanent resident status, but does that mean I can't live with Mindy until the process is completed? How soon could I be working in Canada with this process?

2) Applying Inland allows me to be with her during the process, and allows me to get a work permit, but how long does it take before I can start working?

3) Is it possible for me to stay with her in Canada during the inland process and work an online job based out of the US?

4) Can I apply for a work permit and submit our spousal sponsorship at the same time? Or at all?

5) How much does immigration cost?

Edited: Removed some of the post to avoid upsetting anyone. To be clear, I meant that I didn't care where we were, I simply want us to be together in the same country with the ability to support our family. (meaning with me to be able to work, since she will be on maternity leave)

Wow! I was all set to layout a bunch of help...until I saw that part.

Did you know that if you did want to become a PR of Canada and if you and Mindy ever decided to leave Canada [together], you would still be able to maintain your PR (if she's a Canadian citizen)? But, since you don't care...

It wasn't meant as an insult or to say that I don't want want to reside in Canada or anything of that nature. It was mostly me stating that I want to be with her as soon as I can. The last forum I posted on harassed the two of us and accused us of a fraudulent relationship because apparently my intention to get a job in Canada to try to support my family is a sign that I'm only interested in a Canadian citizenship. If it was faster to bring her to the US I would bring her to the US, if it was faster to move to Russia together and we could support ourselves there, we'd move to Russia. It's not about our location, it's not about the residency. It's about us being together, and being able to care for our new family. I apologize, the phrasing I used could have been better.

i think he is only stressed,,,once you start dealing with cic you lose your hope in the immigration system of this country,,let alone when you start living in it,,taxes,taxes and cold snow,,the only reason i decided to become is for me not to be so judged every time i come to canada,,,but there is nothing interesting here and its system is pretty F@cked up too so,i dont blame him for not caring about PR here,,I do applaud his words on ''wanting to be with mindy,here,there or in the moon,,its shows he really cares,,and thats what matters,,,at least to me..

The stress is indeed pretty awful. Mindy has had a few severe anxiety attacks upon me deciding it was best for me to return home to get the money to pay for all this. When I said I don't care about PR status I was mostly inferring that I didn't care if I became a PR or not, I just want to be with the person I love and be able to help support us. In terms of how your immigration system is, take a look at the US immigration system for spouses. the cost is double and the time for approval is nearly triple. which is why we decided it was best for me to come to Canada. And Canada has alot more to offer than the US if you ask me. The only thing I dislike about Canada is the cold, and the gas prices.

if youre a us citizen you can bring her on a k-1 visa and then adjust her status,,,to become a green card holder..

She wouldn't be able to come to the states for 6-12 months even with the k-1 visa. I've reviewed the process=/

When you submit the K-1 the person in question can't enter the US until the application is approved/denied.

On top of that, she is due in 3 months, once that happens she will be on maternity leave, during which time she wont be able to afford her apartment. I can send her money, but we had plans for her to come to the US on a visitor visa and stay with us after the birth while we started immigration to Canada. I wouldn't be able to do this if we went the K-1 Visa route.

I suggest you get married and send off the application as soon as possible. If you need to work for a few months to get the money for the fees, you can use that time to get the application ready. Outland is generally faster. You can stay in Canada while the outland application is being processed. If you apply inland, you have to stay in Canada during processing. You apply for a work permit with the inland application, but it takes a while to get it. Often longer than the whole outland process takes. If your girlfriend goes to the USA with you, she can still sponsor you, but she will have to submit proof she is planning to return to Canada when you get the visa. So if she tries to get some kind of work visa in the States, probably your PR application will be refused. Basically, she will have to stay in the States as a visitor, or wait in Canada.

Thank you for the information. the plan right now is to marry her within the next month, have her give birth in Canada (hopefully by then the sponsorship process will already have been started) after which shes going on maternity leave which means she'll still receive payment 55% of her weekly earnings every week. for 6 months after the birth we plan on having her come to PA to stay with me while she's still on maternity leave (already researched this, it is possible to do, but we need to get our child's passport/dual citizenship, information on that would also be appreciated. links and estimated processing times are awesome.) Hopefully I'll be approved and able to work before she has to return to Canada. I also hopefully will have saved enough money by then to support us until I have a job in place. At that point we will return to Canada as a family.

does this plan sound like it has any sort of problems that might arise? Border guards for sure will give us hell, but I'll be coming to Canada to get her and the baby myself when the time comes, so perhaps it won't be so bad? or perhaps it's a worse idea.... any advice would be appreciated.

Sounds fine, if she is a Canadian citizen. They can sponsor while abroad. When she and the baby come to visit you, she should bring proof that her visit is only temporary, such as a return ticket, proof she is going back to her job when the mat leave is over, a lease or mortgage in her name maybe with proof she has sublet, and proof of the PR application. Proof that you make enough to support them would help, as would proof of her fincial resources.
