Spousal Sponsorship - Few questions

Hi,

I am a PR and I am now applying for my spouse. She is a US citizen. We have planned to apply outland since she would be stuck in Canada in case of Inland. Here are some queries I have:

1. It states that Sponsor have to send the application to Mississauga and Sponsored to Buffalo. Do we have to send 2 sets of applications forms /w supporting documents to both the offices? Or do I send my set of application forms to Mississauga and my wife sends her set of application forms to Buffalo? How will be decide which supporting documents should be sent with each applications since the supporting document checklist is just one in the application guide?

2. Is the medical report to be sent with the application or will we get an intimation from the Immigration office to get the medicals done after they have received the application? As per the list of supporting documents it seems that we have to send the medicals with the application.

3. How much time does police report from FBI takes? They say 16-18 weeks but one of my friends got it in 6-8 weeks. What is the normal practical response time? Also, can it be sent later on since it will take some time or is it recommended to send it with application to avoid any delays later on?

4. In one of the guides (http://www.cic.gc.ca/english/information/applications/guides/3900ETOC.asp), under the section "Length of Undertaking", it mentions that for Spousal case "Length of undertaking is three years after that person becomes a permanent resident." What does this means? Does it means she will get PR after 3 years?

5. While the immigration application is in process my wife can travel to Canada as a US citizen and visit me. There should be no problem with that. Right?

You need to send BOTH. Get your wife to send you everything that is with hers and put it all together. They ALL go to Mississauga, once you're approved as a sponsor, they will send it to Buffalo. Sent with the application, yes.

Anywhere from 6-8 weeks, though it could be longer. This should be the last thing you get as they need to be sent in to CIC before they are three months old. Send with application to avoid delays.

It means you are taking the responsibility of her financially. Say she goes on welfare during those three years after she gets PR, you have to pay that back. Three years you have to make sure you are able to keep from going on welfare or any of the like. After that (I believe) she can apply for citizenship.

She can yes, but you should travel together as it'll be easier. You do all the talking telling them you applied to sponsor her and bring proof (receipt IE) and that she WILL leave on such and such a date. If she travels alone, they might reject her since she could be moving before her PR and they have no way of knowing it. She should have strong ties to US (proof of rental, bank accounts, job etc).

Hi You must send the complete application to Missisauga from there CIC sent to Buffaloo to finish the proccess..

Honestly I advice you to apply Inland and she can be with you...Outland is so hard,painfull and stressfull and can be so long.Im not sure if she can go in as a visitor but I think that she is not becaause the inmigration agent review and knows she is applyingg to PR.

About medical exam I dont know..I submitted them when I applied but now they have the risk to expire before Embassy review them...

honestly i dont know...but inland you are together outland you are not,you must pay tickket to see each other deal with a slow proccess,financial support,lonelyness etc etc and you dont know when all be finish

Definitely apply outland - don't even consider inland. Since your wife is American, outland should be substantially faster than inland.

Inland makes sense for some - but generally not for Americans.

I second that - you'll be done or almost with the whole process via Buffalo before she'd get first stage approval in Canada. She can't work in Canada either way without a work permit (and can't get one for step 1 in Canada or at any time applying outland). However, you can be together in Canada while you wait out the process since she can visit you as a tourist if she's applying outland - she'll likely get 6 months at entrance and then can apply for an extension (can even be done online). Just make sure she keeps ties to the US so that she can reference them as she enters Canada.

Outland takes longer than inland for a few visa offices, and for people from those countries inland can be a good choice, but for an American citizen outland will be much faster.

Once she gets her PR visa and 'lands' in Canada, she is a permanent resident. She doesn't have to wait for three years. The three years refer to how long you are responsible for her: in practical terms, it means if she leaves you within the first three years after landing in Canada and goes on welfare, you will have to pay the government back.

Hi,

I am in the process of building the spouse sponsorship. I want to make the fee payment online. But, I have a question: Do I need to pay Right of Permanent Residence Fee right now OR should I just pay Sponsor & Applicant fee? What is the total feel to be paid when sponsor only spouse (no family)?

Another query: I don't have any proof of travels together (no boarding passes, tickets or receipts etc.) But, I am sending them the photos of us, our online chats, emails we exchanged and the marriage videos. What else you think I can send? Do we need to send correspondence that happened around marriage or should we also send current correspondences too?

Pay the total fees upfront..$1040. It makes the process faster.

Send any correspondence you have, including anything current up until the day you file! Anything helps. If you don't have airline tickets or receipts, passport stamps, if you used one to cross the border, or if you bought plane tickets online, your e-itinerary, correspondence about wedding planning would be great, and of course photos..i sent over 200 photos myself

One more question: there are some supporting documents for mu spouse's application. And i have to attach supporting documents regarding our relation. So should i make 2 copies of everything and send them, one for each me and me spouse? Or i just send one set of supporting docs as a common set?

I believe the sponsor application is processed at a different office than spouses'. So that's why i wanted to know if just one set is enough?

No, just send one set. In the first step in Mississauga, they don't look at the genuineness of the relationship. That's only at the visa office.

sorry to interrupt. i just have questions that i think u guys can have an answer. my wife is american citizen too, does she have a better chance to enter canada as a tourist if we have already filed for her PR or will it be better if she's already in canada before we file her application for PR? we dont want to be separated for a long time, and i dont want her to have trouble entering canada. thanks

It is more of a outland vs inland application. Your wife can live with you in Canada and you can apply for her PR as an inland application but then she wont be able to leave Canada till her PR is done. The other way to apply outland and your wife can visit you in Canada. As long she can show a reason to go back to US, I think she visiting you will not be a problem.
