Hey everybody,
I was wondering if you can help me with my situation that's going crazy right now.

Well i came to Canada in 2010 as a student. I studied English, I finished my high school and I did 3 years in university. Everything was good until July of 2017 when my passport expired. I applied for a new passport on March of 2017 but until today my passport haven't arrived. BTW I am from Venezuela and for some reason they are taking more than a year to give new passports
I have to add that I met my husband in 2014 and we had been living together for almost 3 years. We got married before my passport expired and we also discovered that I was pregnant. Our baby borned on October and my husband didn't apply for my PR because we were waiting for my passport that haven't arrived, also I wasn't able to fight back home for a faster passport because of my pregnancy. Now I don't have status, I have a baby of 3 months, no passport yet. I also worked during my studies, and I was eligible for maternity leave but if I am not in the process of my PR I am not able to claim it.Right now my husband don't want me to go back to Venezuela because things are pretty ugly down there, plus I don't have anybody to take care of my baby. I don't know what to do. Please help me :(

You cannot apply for PR without a valid passport. So your first and most important step is to obtain a renewed Venezuelan passport.

Once you have a renewed passport, your husband can sponsor you for PR through the inland route and include an open work permit with the inland application. You can apply this way even if you are out of status in Canada. You should avoid working illegally (if you are working right now you should stop asap) since this will increase the chances of CBSA catching up with you and potentially removing you from Canada before the PR application is processed. Same goes for studying. You are not allowed to study while out of status. If you are attending school - you need to stop.

Thank you so much for answering :). No, I stop working and studying when my student visa expired. right now I am just taking care of my baby. The huge problem is that I applied for my passport almost 1 year ago and it havent arrived :( I cannot go to Venezuela also because I have a newborn that has his doctors and everything here plus venezuela there is no food or medicines :( it is a huge risk to go.

I have been in Canada as student for 7 years but right now I don't have any because my country doesnt give me any passport. I couldn't travel back to venezuela because I was too late in my pregnancy :/. I thought I could do the process myself, but I think this process is difficult. Thank you for your replied btw

Yes, this is best consulted with lawyer who will give you all the options.

Have you tried reaching out to your country's consulate here in Canada to see what they can do to help you get your passport?

A lawyer can't do anything. OP just needs to wait for her renewed passport to apply for PR.
