Soo, the conundrum, I phoned the callcenter and asked, and they said I do NOT need to add my commonlaw wife on the application since she was born and raised in Canada. (from Canadian parents)

Anyway, since she IS canadian I can 'neglect' to put her on the application, but I have a feeling that they can take that as misrepresenting myself if they later find out that I am actually marrying her next year... so that will entail a change in my personal status. My concern is also that I want to enter on my own merits, not because my wife is canadian (although that is nice too)

Any thoughts from the experts?? Jen_On, Leon and others??

If applying as a skilled worker, you don't have to include her in IMM 0008 under "DETAILS OF FAMILY MEMBERS" as she's a Canadian citizen. You do, however, have to tick "common-law" for Q9, and include her on IMM 5406 (additional family information). From that form, they will know she is Canadian, and does not need to be included as a dependent on your PR application.

Having said all that, why don't you get her to sponsor you - the process is significantly faster than applying as a skilled worker.
 
I would get her to sponsor me, HOWEVER... I make more than her, and she's currently on EI... We also do not have the 'funds required' in the bank.

Immaterial, as spousal sponsors don't have to meet any income requirement, other than they can't be on welfare, except for disability.
 
So you say I CAN apply as spousal, EVEN with her on EI??

That might change things a tad?
