thats good, also you can send case specific Inquiries to LVO using their webform,,,They do reply if the question is not FAQ
 
Hi - My wife is a canadian by descent, my immigration was in process from June 2014 and in Nov 2014 we had our first baby outside Canada (I had applied for TRV for the birth of our child earlier in 2014 and since i did not get a visa, we decided that its better to have the first baby together in Pakistan)

We added our baby to my application immediately i.e in Nov 2014 only same month he was born.

Since my wife planned to go back to Canada with the baby while i stay back and wait for immigration to happen, we applied for our child's TRV in Dec 2014 and on Jan 31st 2015 got the visa for baby only.

On Jan 27, 2015 we got an email from London Visa Office for the medical of our child, which we did on 2nd Feb 2015 and my medical was extended by VO on Jan 28, 2015.

Now the question is, can my wife and child travel to Canada? Since my immigration case that has the child as depended is "In Process", what happens when we get PR and than subsequent request for passports for stamping the visas?

1) If my child travels before PR, can i only send just my passport for visa and land in Canada with my PR and my child's? is that legal?

2) Is there some clause that, all the dependents have to have visa stamped again even though they already have a valid visa to travel?

I hope i have not confused with giving so much information, but hopefully someone can answer the above queries so that we can plan accordingly.

The only thing worries me is that they are travelling in 2 weeks and we dont have passport right now... Is there any ways we can ask them to do it earlie. CHC doesnt pick up phn callss???? ANY IDEAD?

1. Your wife is a Canadian, so her (first) baby born abroad should be Canadian. Should've applied for baby's citizenship certificate and Cdn passport via CHC Islamabad. I have no idea why you're putting the baby in the sponsorship process at all. Baby is Canadian since mother is Canadian national, doesn't matter where the baby is born. Did you or your wife read the rules on CIC website at all?

You are not automatically a Canadian citizen if…

you marry a Canadian citizen,
you are adopted by a Canadian citizen,
your refugee claim is accepted,
you live in Canada as a permanent resident for many years, or
you are born outside Canada to Canadian parent(s) on or after April 17, 2009, but neither parent was born or naturalized in Canada.


As per our understanding, since the mother of the child was not born in Canada nor was naturalized in Canada, and she is a canadian by descent (Her father being Canadian who himself was an immigrant to Canada, passed the nationality to her)
As per the law after April 17, 2009 any child in these circumstances is not a canadian citizen.

Please correct if there is an understanding gap on our part and we have misread the laws

Since descent is involved, but she resides in Canada normally, anyone would think the baby would be Canadian even if born abroad.
That's what I thought that she is living in Canada (not abroad, and just visiting) so the baby would get citizenship instead of PR.

The conservative govt did not address the issue of visitors giving births in Canada for citizenship for babies, but rather they make it hard for taxpayers to get any benefits....

Allhamdolillah. ...after 3 years and 2 months. .
Now pray for my daughter's passport. .so that we can go canada soon..
