Steph,do i have to file an annulment first.or do i have to file divorce here in canada before i process my PR?
thanks to you,i thougth that its impossible,to get him coz of my situation.
I'm not sure. Do you have to be a Citizen before you can file divorce? There were 2 members before who filed a Canadian divorce, and then went to Hong Kong to marry their partner. You have to be careful because it may look like Bigamy. I think these people were successful. Because Canada recognized their divorce and wedding in HK.

Ours' was long because CIC kept screwing up not because it was difficult. In fact ours' was so easy it should have been done in far less than a year.

Conjugal is difficult and far more scrutiny and proof will be required to satisfy CIC. I would expect it could take up to 2 years. So you should do your best to make your application cover all possible concerns that CIC would have about the genuineness of your relationship before you send it in.

Steph did all the heavy lifting.

hello steph c,

I am new here. I just want to ask on how I can sponsor my partner for 10 years and his son using conjugal sponsorship. He is married and he filed an annulment last year but nothing is happening. He filed it in Cavite and there is a freeze in annulment cases there as they combined all annulment cases in 1 court with no permanent judge. So we were told by our lawyer that it might take long as there are 5,000 cases all in all. I am PR here in Canada for 3 years and I went home every year just to be with them. My family even went home last year hoping i will be marrying. To make the long story short, I just want to know if you think we have a chance? and what are the proofs that I can gather for the application? your reply will be greatly appreciated.

Yes you have a great chance! Go ahead and apply. Just provide proof of your ongoing relationship and provide proof of the annulment being stopped. You will need proof that your partner is living apart from his ex wife and that they are totally separated. We had good luck in that my partner's ex sued him a bunch of times, and those lawsuits provided great proof of their conflict.

Some things we provided:

Cover page of the relationship proof was just a timeline of all our times together and apart, where and from what dates. ( I provided that because we had a lot of time physically together and wanted to show them)

A word document with pictures of us together through the years of our relationship and some text saying the dates and events in kind of a story line fashion

Plane tickets and other proof (we added work contracts for the same place to show we were both there)

Letters and emails of support from as many family and friends as we could

2 notarized letters of support from family and friends (as is required in the country specific guide, I think)

Chat logs, Skype Logs, Phone Bills ( I realized later that we sent way too many and most were discarded. Anything showing a snapshot or general summary would be good)

Legal documents pertaining to the annulment and pertaining to his situation with his ex, such as child support agreements

Documents about the house we rent together and communication and payments sent to the landlord

how do you do the letter of supports from friends and relatives? and the word document you did with the pictures? you printed the pictures with captions in a paper? Am I correct?

Just email all your mutual friends and kindly ask them for a letter in support of relationship. Ask them to make it in their own words but include details such as where they met you, how long have you known each other and from where (eg, a relative, co worker, neighbour), how they came to be aware of you as a couple, for example first introductions, maybe list specific events or outings that you had spent time together, and how they feel that you're genuine as a couple.

For example:

To whom it may concern,

I'm a friend of ____ since ___ when we were classmates/coworkers/neighbours at ___. After school we remained close friends on facebook/as our parents are also neighbours/or because we have a mutual interest in turtle racing clubs. I was first introduced/ heard about Boy when Joy told me ____ and we met on _____ at______ and did _________. I noticed while they are together they ____ (insert sweet thing) and he always _____ . I have known them for ____ years and I think ____ (what they think about you as a couple and maybe mention how you want to be together or are always in communication with each other.. we asked for a sentence about how we lived together previously and to write that they visited us there) (Add a sentence or two about the child and how you are like a mother to him, maybe some examples of certain instances)

I know people aren't terribly creative so don't spoon feed them letters like I did here... haha.

A letter from the kid's teachers would be really helpful, anything that puts you in a parental role there.

The word doc is just digital pictures put about 4 to a page with added text.

sorry for many questions, does the letter needs to be notarized?

As per the country specific guide, I think it says 2 should be notarized but you will have to read it yourself.
