No reason to not mention that you were together in 2020 and 2021, even though you were not a common-law couple, you were still dating, right? It can only help to show that the relationship (but not the cohabiting) was established then.

I suggest you print out all forms that you will eventually need (now) to get an idea of what questions you will have to answer. You can only apply online, so having a paper copy of the forms to practice on will at least make you feel that you're starting the process...sort of.

Ponga, that is exactly what is happening, he works for a company from outside Canada, but as a contractor and pay is low, but not sure how this would help.
Whatever he can earn remotely without violating Canadian laws would be helpful, right?

Does he have legal status in Canada?

Is he deemed to be a tax resident of Canada (even if he has no legal status)?

Ponga, he came in Canada as a tourist in June 2022. He left within the six months required by the eTA, and the work he is doing is for a company that doesn't operate in Canada, so i am sure he didn't break any laws. Romanians don't need a visa to enter Canada, only this eTA, which allows him to stay 6 months at a time.
No, he is not a tax resident, he doesn't have any significant ties in Canada (though by putting him on the lease wouldn't mean exactly that?).

Yes, i know that it's what it seems, that i am all over, this is why i started this thread, because i am confused and i don't know how to move forward with this :)
And i thank you people for pointing this out to me, as it feels like i am biting my tail..
Ok, so i should somehow forget about march 2020 to september 2021 (though on imm forms i have to provide exact dates when we were together since our relationship started, so i cannot really forget about that period :)) and focus on june 2022-june 2023. March was the month when i went back to Romania, stayed there until June so cohabitation in Canada started in June 2022.
So that means that i can apply after june 2023, when a full year has passed and i can provide the above mentioned affidavit. I am right now on hold with Simplii bank, to see if i can add him to my bank account.
So hopefully by that time i will have affidavit from my landlord, beneficiary on my RRSP (i can do a will if that helps), i will try for the lease and bank account.
Just so you're aware, even with the affidavit, you'll still be on the thinner side with the evidence. Ideally you should really have more to prove cohabitation right from June 2022. Did your partner get any letters or packages sent to your joint address that you can show (preferably from June 2022)? Did your partner update his address on any documents of his own such as bank account or credit card statements? What about his employment? Did he change his address with his employer or leave as is?

No packages, no letters for him :(
He did not update anything in his romanian bank accounts, though now that you mention it, for the work he has been doing, he gave my address, and my phone number. Funny thing is, now that we are back in Romania, he changed them back, but hopefully he can find some screenshots or previous works where my address shows up.
We went to Cuba in October, we went camping all summer (and they require both names and address, but that might mean nothing).
With all this you guys are telling me, I am not even sure it is worth to apply for them just to reject my application. We are in our 50s, not trying take advantage of anything, and a move from Europe to Canada is brutal, Canada is very different as lifestyle from what's in Europe.

If you're not willing to get married, but applying to sponsor on a basis that is meant to be "same as married" (essentially) but short of the evidence needed to demonstrate it, your goals and constraints are incompatible. You'll have to adjust something.

I am not sure what to adjust, but this is something I won't.
You know, I came in Canada in 2003, sponsored by my now ex. At that time there wasn't the common law category. And if I weren't married, I would have left much earlier from my marriage, but because I wanted it to work and because I was already divorced once, I had lots of second, third, forth thoughts if to leave or not. I stayed 16 years.
I don't want for this to happen again. I don't want to stay in a place or relationship because of a paper.

You can absolutely try applying with the evidence you have and hope for the best. None of us here work for IRCC and we can't tell you what wil happen.

This means making sure that going forward, you have joint leases, joint bank accounts, joint utility bills, etc. That way if you run into issues with the first application, you know you have a much stronger application if you have to reapply (which hopefully you wouldn't have to, of course).

For the most part it sounds like those were decisions of yours, but I don't know the details and it remains up to you.

- If you apply inland, he wants to avoid leaving Canada for any reason for too long (i.e. longer than 3 weeks). The inland immigration process requires both of you to be cohabitating in Canada. If this is going to be a problem, then apply outland. But note there is no OWP granted with the outland process.
- Assuming you apply inland and qualify for the OWP, you can apply for the OWP after you have AOR (after submitting the OWP application). It will take a few months to get AOR and then several months longer to get the OWP approved.
- Medical and everything else can be done in Canada.

If there are other questions you have, list them out as bullet points. Your posts ramble a lot and it's hard to pick out all of the questions / points of information. You'll get much better information here if you are succinct / organized and do things like list your questions in bullet points or lists. Otherwise it's just too much work for those answering questions here for free.

With all you've said @mrsTF, one big question for me is why don't you move back to Romania? My FIL did after living in Canada for many years and he's been pleased about his decision. You sound very uncertain about doing the thing (marriage) that would make your application much more straightforward, concerned about him immigrating at his age etc.

Believe me, this has been something in my mind for a while now..It is just not that easy.
I have to have a plan, and as you can see I am all over the place :) Work when you are 50 yo not easy to find, investments, pension, etc. Lots of unknowns, but i am working on it.

Scylla, i will apply inland, this is the plan. we go back in march 2023 and we start this process. No reason to leave Canada, other than if something very bad happens with his parents.
