Hi everyone.
I need some help about my process

I'm going to get married in 10 months and here are my questions.

- Can I send the process before I get married?
- One of us has no status (visa) in the country? Is this a problem?
- Is it better to get a lawyer?

1.) You can start preparing the forms and everything, the applicant can also take the medical and get the police certificate (take note that these do expire, so don't get them too soon). But you can not send the application until you are married - until you are married, the applicant is not a member of the family class and thus can't be sponsored.

2.) It could possibly be. What kind of an application are you doing, inland or outland?

3.) I'm not sure what the situation of the one without the visa is. Possibly yes, but not necessary.

I agree with mitamama.

I started working on our papers months and months before marriage. That way once we got married all that was left to do was include pics of the wedding, marriage cert and proof of that trip.

DO NOT WASTE TIME...distance is a killer and do as much as you can now. I know that is the best thing that I did.

Yes, we're planning get married in Canada and the application going to be inland.

If you meet the requirements for Common Law (having continuously lived together for the period of one year) you could apply now as common law. If not, then apply AFTER you get married.

You don't say which country the one with no status is coming from. I'm assuming it's a visa exempt country because you didn't ask any questions about getting a tourist visa to get married in Canada. Why would you make an inland application after marriage? Outland is usually faster processing and there is no right of appeal if refused on an inland application.

mitimata is right about the medical and police clearance. You can do both before the marriage BUT remember that the medical is only valid for one year and the police certificate can't be more than 3 months old when submitted with the application.

You probably don't need to hire a consultant or a lawyer but it might be worth your while to pay for a consultation to get some advice about how to proceed. There are lots of ins and outs to this process that are tricky and being prepared is the key to success. Good luck.
