if I want to come to canada to do it like everyone else and PAY UP

That doesn't sound liks a scam to me. The "everyone else" tells me she is saying if you want to come here you can do it the same way as everyone else. Part of that will be paying your fees. If you want a lawyer then you need to pay that too. In other words "if you want to come to Canada, pay for it yourself like everyone else". Gee, what a scam.

As it is, you never submitted the app so you have no need to be here. Go find a legal site on divorce law. You will no doubt be able to end your marriage with minimal to no financial impact. Of course you WILL have to pay for a lawyer for the service. Or is that a scam?

So chances are she would have to come here?

Unless she has money to get a lawyer to file an injunction and argue the divorce should take place in Canada (if that's even allowed there). Judging from your descriptions, that won't be an issue.

I normally hate how lawyers and justice is so based on wealth, but in this case, I'm okay with it ;P

You'll need to check your laws in Luxembourg. Find what what their requirements are and go from there. Either way, you go home. She files in Canada after a year. If you don't respond within so many days, it's a default judgment. Unless you plan to return to Canada in the future, it won't do much.

I would send her an email or certified letter (or have the lawyer do it if you end up with one) saying "This is my legal address for any divorce matters. All divorce summons and requests must be sent to this address." That way if she does try to slip by and give the courts a bad address, then wins a default judgment, you have a leg to stand on if you want to challenge it. Oh yeah, and save that email/letter/signature confirmation! (If you aren't sure about an address, use your parents.)

Then you'll hopefully get a notice. If she asks for anything nuts, you can decide whether or not its worth it to you to fight it. Or if she's smart and asks for a clean break, you can ignore it and let it go to default judgment. After a few months (it was 4 for my husband) you can get your divorce certificate and all done.

By the way, just for kicks, you might want to plant the seed that since she's working and you're unemployed, she might have to support you. I have no idea how true that is where you are, but it was true in Georgia. The unworking spouse has a much bigger right to alimony than the working spouse. That might get her to agree to a clean divorce.

You could also try to get a separation agreement signed NOW that says there are no joint debts and no alimony or support payments. You can download a copy free on the internet. (If you can't find one, let me know. I might still have the copy I made for my husband's divorce.) Some provinces accept separation agreements with proper signatures (usually including witnesses) as legal contracts between two people. In fact, if I were you, I just might make one the way I like it, sign it, then see if she'll do the same.

Scos - If you didn't read everything I posted after. I said I was the one paying my own fees, and lawyer for immigration. She knew I was paying for my own lawyer. She told me in the same email it's over if you want to come then do it like everyone else PAY UP!

Mevakesh - I get over $14.50 per hour after taxes, 401k, dental, full medical paid. I only pay 5% they pay 95% if it's in the hospital they pay everything! I get dental 100% so yeah plus living in a top rich country, plus on top of it, it's the safest in the world one of the safest!

gsize - Thank you! I wanted to give this to immigration in her city so if she ever remarried again to someone else who has money or something, it would save them a lot of work and pain! I lived in Canada for 2 years and economy there is pretty much dead in the city she lives in and from what I have seen. And food prices are more then here! And the pay profits is less then 50%.

Frankinto - Alright so one year it is. I'll have to wait. This is going to suck! I can just imagine the problems for 1 year. No minimum wages are not the best. Here it is.

Malawi - We never lived together!

Thank you all!

You have to consider that Luxembourg would fit about 67 times just in Southern Ontario. Your population is less than that of Winnipeg and your wealth comes from being a tax haven.
Don't get too proud.

I'll try not to. I haven't worked in 8 months and still get that amount up to 2 years. :)

I know it's like this due to tax heaven laws and all. It's just great being in a place like this I tell you.

Ok, so interpret it for us. If you had said "she said if you want to come here pay me $20,000." then that would be one thing. And the fact is she would STILL be on a financial hook for you (so if she is asking for money it better be more than 3 years worth of welfare). So I STILL fail to see the scam. When there are scams they are either where the applicant is the scammer, or both are scamming via a business arrangement where the applicant pays the sponsor. But in that case BOTH are the scammers and that has to be on good terms because otherwise the applicant can make the sponsor pay later. And even if there were a scam for the 18k you say she was in debt, if you came here and went on welfare that would negate that amount very quickly. And finally, you keep saying you aren't really eager to come, so you would make a terrible mark anyway! Scams work because the victim wants what the scammer is offering.

I wish one day I and my wife could visit Luxembourg

Your welfare comes from the taxes the rich are unwilling to pay for the money they earn in their own countries. I guess if you are a welfare bum then Luxembourg is the place for you. Would you like to take all of ours?

im trying to follow this but I got to admit...its not easy to do.

Time for another Corona ! Hey if my Mexican cant be with me here, then at least I can do is have a Mexican beer

She has a debt maybe she looked at me as a nice guy to pay for it. But her saying in the email IT's totally over, and if you want to come here, pay up like the rest. In those type of words. I was already paying for my own lawyer so it's not Canada immigration fees. She demanded money from me! That's it! Plain and simple. And I know it's 3 years, plus they have to pay up to 5 years. So $500 a month times 24 months is like $12k only. Here in Lux it's $1900 a month. And it goes up twice a year by $50! Pays off! :)
