Hi

Could someone please advise whether I can sponsor my brother from Ja on Humanitarian grounds. I know I would not be eligible to sponsor my brother as I have a spouse here in Xanada but given that my spouse has a disability and I dont have any family support here, would I be eligible to sponsor my brother under humanitarian and compassionate grounds?

He doesn't have H&C reasons those are your reasons or your wife's reasons. You are basically asking him to come help you which would mean work which is not allowed.

Agreed with the above. This is not grounds for an H&C application. If your brother wishes to immigrate then he will have to qualify on his own.

Thanks. Point noted. While I agree they are my reason Cdn immigration does allow for you to file for a relative if you have no spouse and are alone. In that case it would be my reason as well wouldn't it

You have a spouse so you can’t sponsor your brother. If you have children, you can’t sponsor your brother. If you have parents or grandparents alive anywhere in the world, whether they want to come or not, you can’t sponsor your brother.

Yes I hv a spouse but none of the others. My spouse is absent a lot of times due to disability so I wondered whether an exemption could be considered for emotional and physical support while my brother would be able to work and support himself

You either meet the condition to sponsor your brother or you don’t. Unfortunately, in your case you don’t. There aren’t any exceptions to the process.

No possibilities for an exception. This isn’t an H&C situation per IRCC rules. Your brother needs to qualify on his own through an economic immigration stream like express entry if he wants to move here permanently.
