Hello,

We're new to this forum and have a few questions!

I'm a Canadian Citizen currently a US Permanent Resident. My husband is a US Citizen. We are considering moving back to Canada to be closer to my family. We've been married 2 years.

We're doing some preliminary research to try and figure out our options. We'd ideally like to move back by October 2012 if all goes well. I realize this means applying for PR once we're already in Canada which appears to be a longer process.

Here's our question: CIS website states that the sponsor needs to have proof of ability to provide financially (12 months paystubs). How is this possible if we move back there together and I only get a job once we're there? We'd ideally like to stay together the whole time.

Also, is it possible to move across the border together w/ our belongings before he starts the PR process? I realize he would only get a 6 mon visitor visa. Once PR process is started, is it possible for him to stay longer than 6 months?

Thank you in advance for your help/patience with all our questions!

Spouses sponsorships are exempt from the Financial requirements. You don't need to produce 12 months of paystubs. I think you are reading the wrong set of instructions. http://www.cic.gc.ca/english/information/applications/fc.asp

You're exempt from any specific income requirement, but you should still show how you intend to support yourself in Canada without relying on welfare. If you don't have a job when you file, you can include things like letters from family members stating that they will help support you until you get on your feet, or bank statements showing that you have some funds to get you started. I think they also look at work/education history.

It's possible to move across the border before starting the PR process, however, you will need to be able to convince the agent at the border that it is only a visit and that your husband doesn't intend to illegally overstay. You can also extend the 6 month visa before it expires, however, an extension isn't guaranteed and is usually only granted for 6 months at a time.

Your other option for staying together for the process is to wait to move back until sponsorship has been approved. As a Canadian citizen, you can sponsor your husband without living in Canada as long as you show plans to move there once he has his PR.
