Hi,

I am a canadian citizen and I am currently in the process of doing an outland sponsorship for my wife who is europeen.

She had a DUI here in Canada (Quebec) back in november 2015. I am wondering if the sponsorship can still be accepted? What should we do? What steps should we take to make it work.

Is the sponsorship going to be automaticaly refused? Or is there something to be done.

We are also looking for a good immigration lawyer who knows how to deal with Criminal inadmissibility in the area of Montreal, so if someone could suggest, it would be appreciated.

The sponsorship portion (meaning approval of you as a sponsor) will likely be approved, but she will not pass the inadmissibility part, because of the DUI.

Until/unless she can get the charge withdrawn or reduced, she's going to be inadmissible to Canada.

The sponsorship app will be refused. It will be 5 years until she qualifies for rehabilitation and would be able to apply for PR.

No lawyer can change that. CIC will not overlook her DUI and there are no H&C grounds. Don't let a lawyer talk you into paying thousands and thousands of dollars to try.

More like we are going to need it :(.

That is not the answear we were looking for. What about the following options: Getting a company to sponsor her to work for them. Applying for TRP or TRV.

And why does HandC not good for her, if I may ask. Isn't it for people who are inadmissible in Canada.

1. She is still inadmissible whoever sponsors her. H&C can't be considered by the IAD if the person is convicted of a serious crime. There is no appeal

As said above, she is inadmissible regardless and H&C is not for people who commit crimes.

With a Nov 2015 conviction, she is looking at 2021 before she can apply.
