Hi there

I sponsored my wife to come to Canada as a PR. She still has her US status. After 15 months of marriage we are separated and she will be moving back to the US.

1. Do my sponsorship duties still apply?

2. Should she relinquish her PR status or does it matter?

Your obligation to continue to support her for the sponsorship agreement you signed does apply as shes no longer living in Canada and wouldnt be a burden on the Canadian taxpayers. Although you still may owe her spousal support but that's between youand her and the lawyers. She doesn't have to relinquish her permanent residency but if she does not reside in Canada the 3 out of 5 years she will lose it.

Only if she stays in or comes back to Canada and goes on welfare with in the 3 year period after she landed as a PR. Then you will get the bill. You can also not sponsor another spouse during that 3 year period.

It is actually fairly hard to relinquish it but if she stays outside Canada, she will eventually lose it because she will not meet the residency requirements.
