This is normal. You can still apply for PR inland if you are out of status and everything can still be approved.

In my opinion you are definitely out of status and have been in Canada without status since mid 2018. This is why you haven't received the OWP yet.
Thank you for all the replies. I just checked the site and it says eligibility passed on March 20, 2019. Maybe that is normal and it's going to be rejected. I dont know again thanks for the responses

Yes - that's normal. Once your wife withdraws sponsorship, the application will be refused - that is guaranteed (the application cannot move forward without your wife's continued sponsorship). You should assume you'll be in Canada out of status at that point. You can try the H&C route. The challenges with that are that approval chances are low and processing takes a long time. It will be well over a year before you know if you have first stage approval and qualify for a work permit. So you'll need to consider how you'll survive in Canada for over a year without working and without access to social assistance.

Best option would be to apply for PR through an economic immigration stream like Express Entry. However you can't do that from within Canada since you are here without status. You would need to leave Canada to fix your overstay.

That's pretty common - unfortunately a lot of OWP applications don't get linked automatically. You can attempt to link it through the system, but it not appearing could mean two things:

1. It's just one of the many OWPs that never show up.
2. The application was returned because you are not in status.

Thank you Every one for the replies and concerns. My wife and I speak daily and there has been no aggression on either of our parts. We are committed to remaining friends and she knows how much I love my daughter and has indicated many times over that she wants whats best for our daughter and has no intention of keeping me from her. Her lawyer is drawing up a custody agreement that we have verbally agreed upon and then of course I will have it reviewed by a lawyer to make sure it is legal and binding and acceptable. It is an extremely complicated and delicate matter and there is just no other way to ensure international custody agreements without trained professionals. I also appreciate no one bashing my wife here. She is an amazing woman and mother and were both committed to keeping this amicable. These are very tough times indeed but in the end I truly believe everything is going to be ok.

Something interesting happened today. When I got home from running errands I noticed an envelope protruding from the mailbox. It was brown. It had been opened and taped shut again. It's from the immigration services. It says everything is approved just need to pay the Right of permanent residence fee and go with my wife for a final interview and my work permit will be approved. I tried to pay it online but when I got to the end it wouldn't accept the payment. Perhaps my wife has already removed sponsorship which will make this process invalid. I cannot go to the interview alone and I can't make the payment anyway. The parliament representative told me that she contacted immigration and my status is fine. Pay this fee, get the interview and I get an OWP. This would of course mean my wife is responsible for the sponsorship obligation. I'm done fighting and I want honesty with my wife. I texted her that something interesting happened today. When she responds I plan to share this info with her and assure her that I would never expect her to pay my rent and will still give her the amicable divorce that she wants. Perhaps this will allow me to return to Canada and work and be near my baby. Please spare me the dont be an idiot just pay it speeches. The ball is still in her court or she may have already reported the sponsorship breakdown. I know she is planning to soon. Either way I'm going to support her decision. Today has sure been interesting though.

I'm sorry for all you are going through.

The ball is just as much in your court as your wife's court. You cannot move ahead with obtaining PR through your wife. That's simply not an option since you are no longer together. You would have to lie at the interview if you went ahead with this plan which is fraud. Regardless of what you do, you don't want to lie to IRCC since this could put you at risk for a 5 year misrepresentation ban which would make your situation much worse than it is now (i.e. having to leave Canada and not return for 5 years).

The best thing you can do right now is focus on how you can obtain PR independently without your wife's sponsorship. Good luck.

The OWP doesn't factor at all at this point in time. If you don't already have it, you wouldn't be given it at a landing interview. I think that you may need to reread the letter.

The other thing is that the fee payment system is independent of the actual application, or you wouldn't be able to pre-pay for anything. I suspect that a different error was present, unrelated to the sponsorship.

So that you know - MPs aren't immigration experts and often have some pretty big misconceptions about the process. We generally advise people not to take any immigration advice from MPs.

At this point the only way to get PR through your wife is to lie. To get PR, you must attend a landing interview. You would need to lie at that landing interview and state your relationship is still ongoing / you are living together. Paying a fee does not get you PR (the fact the MP thinks this shows how little they understand the process) - the landing interview gets you PR.

So what happens when I have to leave Canada? Does anyone know how it affects my chance to return on tourist visa, etc? We aren't going to lie. I am just curious if I'm going to be banned on returning to Canada for a time? My daughter will mainly live and Heaven forbid if she were to get sick could I come see her?
