Hello, I am in a situation I think nobody ever had. Please help me.
I am gonna try to make my question as simple as possible.
I became Canadian citizen in 2005. I have been working in USA on a TN visa since 2007. I got married in September 2008. My wife applied TD visa at the US consulate but got denied twice. Now I am going to sponsor her to come to Canada and am filling the sponsorship form. I have several questions need your help:

1) do I need complete the Financial Evaluation form?
I got confused about Financial Evaluation. in the application guide (http://www.cic.gc.ca/english/pdf/kits/guides/3900E.pdf) page 15, it says: If the person you are sponsoring is: a) your spouse, common-law partner or conjugal
partner and he or she has dependent children who have children of their own; or b) your
dependent child and he or she has dependent children, you will have to complete the Financial Evaluation form instead. But when I read the Financial Evaluation guide (http://www.cic.gc.ca/english/pdf/kits/guides/5482E.PDF), it says:
If you are sponsoring a person other than
your spouse
, common-law or conjugal partner who has no
family members,blablabla, you must prove that you have an annual income that is at least equal to the minimum necessary income to support the group
of persons consisting of blablabla…

I got confused. I am sponsoring my wife, do they need my financial evaluation form?

2) a question from Sponsor Questionnaire (IMM 5540) asks, provide proof of your intention to re-establish in Canada. or Give details of your plans to re-establish yourself in Canada.
Actually I don't know how to answer this question. Because I don't have a job in Canada; I don't have an acceptance letter from an institution in Canada; I don't have any Properly rental agreement and no Mortgage on property. How can I answer this question?

3) I don’t have plans to re-establish myself in Canada. But I had rented an apartment in Canada which was sublet to a schoolmate. my name is still on the lease contract. I also have phone number on that address. Can I fill the sponsorship form saying I am still in Canada? If I can do this, then in the form I will not provide my job information.
I am just afraid if I don’t have job information, then there would be a problem about my income?


Any great idea? Can anybody help me out? Thanks!!!

You will not be denied spousal sponsorship if you don't have enough income but you can put it on there if you want to.

Financial evaluation form they need if like you said, your spouse has dependent children who also have dependent children of their own or you are sponsoring a dependent child who has also a dependent child. So basically, does your spouse have grandchildren and her children, the parents of these grandchildren are under age 22 and dependent on her?

If you want to sponsor from outside Canada, you need to find something to prove your intentions to live in Canada when your wife gets PR.

If you say you are already living in Canada, it would be easy for immigration to double check that. They have access to the US border information and if they are in doubt, they will want to see your employment info and tax records. You can get in trouble if you lie.

Actually I can't find any thing to prove my intention to live in Canada. This is the most headache issue i have. I don't want to quit my job in US; and I can't afford a house in Canada right now. Actually I just want to retire in Canada; this will be about 35 year later. any good suggestions, thanks!!!
