Hello everyone,

I hope someone can help me with this case. My husband is a Permanent Resident (I sponsored him 3 years ago). He has children from a previous marriage who were included in his application, but they were non-accompanying at the time. They have recently come to Canada and we wish to apply for permanent residency for both children. It is my husband who will sponsor them (inland).

We're having a bit of a challenge with the immigration form. Actually, we're not even 100% sure it is the right one. Is it the "Application for Permanent Residence From Within Canada – Spouse or Common-Law Partner in Canada Class (IMM 5289)"?

I believe you must use outland application package for dependent children: http://www.cic.gc.ca/english/information/applications/fc.asp

I don't think you can sponsor your children inland. Others can advise for certain.

Of course they can still stay in Canada as visitor/student during the outland application process.

I agree with Rob, I'm pretty certain you can't sponsor minor/dependant children inland. It must be outland.

H&C PR sponsorship for dependent is the only option available for dependents through inland. But even this route is not advisable but only as last resort. H&C grounds is one of the longest processing time as compared to normal outland PR dependent processing.
