Either would be fine. In either case, attach a letter explaining your circumstances -
that you are still living together. You need that for the common-law eligibility. People on this forum have come to Canada as a visitor and stayed here for 6 months or more, and put this Canadian address as their residential address. None of them have reported any problems doing this.
In your case I think it is better to use the Canadian address as your residential address, and as the address where you are living: you
are living there, no matter your visa status, so it is true; plus you have to make clear that you are still living with your partner to get the 12 months of cohabitation.
- Also, in the same question,3 after the address it says "If you are sponsoring a member of the spouse or common-law partner in Canada class, do not complete b and c, proceed to 7 immediately". Does this have something to do with an inland application? The "common-law partner in canada class" part confuses me. But the two questions, b and c seem to be relevant if you put a canadian address, as they ask about where you want the application to be processed.
"A member of the spouse or common-law partner in Canada class": this is all one phrase - they are referring to the class of spouses in Canada and common-law partners in Canada. In other words, this is referring to the 'inland' application. To sponsor someone inland, they have to be living in Canada, so 6. a) has to be a Canadian address, and b) and c) can't apply. You are applying outland, so if you do use the Canadian address you will have to answer 6 b) No. You have not been admitted to Canada for one year, so your outland application must be processed at the visa office responsible for your country of citizenship.
The same question seems to be asked in the eligibility assessment "Are you sponsoring a member of the family class or a member of the spouse or common-law partner in Canada class" so we must put YES to this otherwise she will not be eligible.
Yes, put 'yes'. Here there are two choices: she is either sponsoring a
member of the family class (that is, ouland)
or a
member of the spouse or common-law partner in Canada class (that is, inland).
- These questions seem to match up with IMM 0008 Question 14 and 15, which asks my mailing address and residential address. So I assume they must match the address put in IMM 1344. So which way should we put it, we are outland, I'm currently in Canada on a visitor visa and we need these weeks until Feb 9th as days living together. So which address would be best to put.
I say use your Canadian address as your residential address. Attach a letter explaining your situation very clearly, so even if the visa officer thinks it is the wrong choice, he/she will at least have an explanation of your situation and why you chose what you did.
