sponsoring a spouse after divorce.

myself and my wife got married in oct 2017. then we applied for canadian pr and got the pr card in december 2019.

we got pr through express entry ; my Wife was Primary applicant and I was Secondary applicant. (NOT SPONSORED)

Unfortunately we had our differences and decided to seperate in september 2020 and i moved out .

MY QUERY
after getting divorced i would like to marry someone from my home country India.
can i sponsor my to be new spouse for immigrating to Canada after getting divorced ....... or will there be any waiting period or denial?

Would expect much more scrutiny. Did you live together in Canada? For how long? Did you apply for PR soon after marriage? Did you have a long dating history or was this an arranged marriage where you got married soon after being matched? Did you and your first wife have similar education, work and English language backgrounds? I see she was the primary applicant.

- yes we lived together in canada as well 4 december 2019 to 31 aug 2020


Did you apply for PR soon after marriage?

-we applied for pr around 1 year after marriage. we married oct 2017 and became pr in december 2019


Did you have a long dating history or was this an arranged marriage where you got married soon after being matched?
-it was a arranged marriage. But we had courtship period of around 1 year.


Did you and your first wife have similar education, work and English language backgrounds?

- we both have different education backgrounds , she being a teacher and myself an engineer. but we both had english language backgrounds.

we both gave IELTS( both of us scored LRWS- 8,7,7,7) and both got our educational credentials evaluated which addded to crs scores when creating express entry profile.

I am clarifying this as to make you aware that myself being secondary applicant , but all my additional points were added to crs score as well.


I see she was the primary applicant.
- she was the primary applicant and i myself was the secondary applicant , NOT DEPENDENT in the EXPRESS ENTRY PROFILE

2. there wont be any objection from ircc pertaining to their laws that can bar anyone for certain period of time to sponsor immidiately after getting divorced?

You have to get divorce, re-marry and apply for sponsorship, in that order.

You cannot sponsor only if you have been sponsored in past five years.

You shouldn't have an issue sponsoring a new spouse. You need to be divorced first of course but you have lived together for a few years and around a year in Canada and there don't seem to be any other warning sign that this was a marriage of convenience. Since you weren't sponsored there is not 5 year waiting period.

You need to be divorced first of course but you have lived together for a few years and around a year in Canada and there don't seem to be any other warning sign that this was a marriage of convenience. She was already in canada as international student and get married to a guy and get her Permanent residency through him and due to personal reasons they got divorced now. She got her PR two years ago. I am on Work Permit now . Could anybody tell me that Could she sponsor me For PR in canada

she has to wait and complete her 5 years then she can sponsor you .

Five-year sponsorship bar [R130(3)]
A person who became a permanent resident or a Canadian citizen after being sponsored as spouse, common-law partner or conjugal partner is barred from sponsoring a spouse or partner within five years of becoming a permanent resident, even if they acquired citizenship during that period.

This is not enough information to determine. You must find out whether your girlfriend was sponsored as a spouse by her ex-husband.

The distinction is that if your girlfriend's husband was in process of becoming a PR, and she was added to his application, this does NOT count as a sponsrship and there's no bar.

If she was sponsored as spouse - see the post above by @idkme .

Her Ex husband was Born Canadian citizen and when she was sponsored by him she was international Student in canada

Then she only qualifies to sponsor you after 5 years from her landing date as a PR. Assume she will have proof that her previous marriage was genuine and did not end soon after receiving PR.
