I am a Canadian citizen who came to India at the beginning of 2020 for my marriage.
After marriage I continued staying with my spouse and still am in India due to:
- COVID-19 flight problems.
- Privilege of work from home by my employer at Canada.

My plan is to finish and submit the application before leaving India.

On form IMM 1344:
1. Sponsor residency declaration: Are you a Canadian citizen living exclusively outside Canada?
2. Sponsor eligibility assessment: Do you reside in Canada and in no other country?"

What should be my answer for 1. and 2. ?
Could somebody guide me? I’m not living “exclusively” in India just temporarily.

I would say for the purposes of this form, you are living exclusively outside of Canada, and then provide a letter of explanation regarding your work arrangements (and esp eg taxes if you continue to pay in Canada) and the delays etc that occurred because of covid.

As a citizen you can sponsor from abroad. Those who do need to show intent to return to Canada; your Canadian employer and any other arrangements you have in Canada will help. If you're serious about returning, it should not be difficult.

Even better is if you can return while your app is being processed and just advise them of change of address. You may want to apply for a trv for your spouse, even if the chance of a refusal is there.

  2. Do you reside in Canada and in no other country? NO
  3. Provide a letter of explanation:
    1. Work arrangements: A letter from my employer(my manager) stating that I was allowed to visit India for my marriage and work from India.
    2. Tax payments: How can I show this? photo copy of pay stubs are good enough?
    3. Delays in flights due to Covid: will state that Canada has banned flights from India for some time.
  4. Intent to return to Canada:
    1. Canadian employer: A letter from my employer(my manager) asking me to return to Canada within a month or two is good enough?
  5. Advise them of change of address: I suppose after I submit my application I will contact them after reaching Canada and inform them of my address change.
  6. Apply for trv for my spouse: May I know what is the benefit of doing this?

1. Sure, not complicated.
2. Again, not complicated. Whatever shows you're paying taxes on your income in Canada.
3. Pretty obvious.
4. It's really up to you to decide how to show. The major points of life in this regard are work, a place to live, and concrete plans like moving arrangements, tickets, etc. They don't all have to be perfect so decide how to show based on your cirumcstances.
