Splitting up with Common-Law while inland application in process - OWP okay?

Hi guys,

Sadly my Canadian gf and I have split up and will be bringing a halt to our PR application. :(

As it was an inland application I'm wondering if my OWP will be terminated once we withdraw the PR application, does anybody know? I've had a look on the CIC site but I quickly become frustrated.

It was issued in January 2016 and runs to 2018.

My current contract runs to the end of June so I'm sure we'd just wait until then to withdraw the application if so but I'd like to know for sure, maybe in the near future I'll return to Canada for some short term work and travel.

was your work permit granted in connection with your ex gf? If not then you should be fine.

What kind of work permit do you have? I do not see why they would terminate your work permit if you decide to take your application back.

Sort of, it's the Open Work Permit that I applied for along with the PR so that I could work while the PR is processed.

It says in the remarks

Temporary resident status maintained as per R183(6). Pending FC APR.
So if the FC APR is withdrawn I wonder if this would be to should I attempt to re-enter the country with it.

If the PR application is withdrawn, the OWP should be as well.

There has been a case where an app was withdrawn. The OWP remained valid.

My vote is with canuck_in_uk. I think the OWP remains valid.

Sorry for late reply to my own thread, lot going on over here.

Don't suppose you have a link to the thread of the person that was able to stay?

My future is up in the air at the moment but the only think I'm (fairly) sure of is that I'm going to back home to Scotland for a few weeks once my job ends in July. My ex will then withdraw the PR application.

If I decide to comeback to Canada, and try a different city (barely been out of Calgary since getting here in Jan 2015) - would I be denied entry with my valid UK passport and this work permit.

If I was, could I still get in as a visitor...?

I agree that it will probably still be valid, even though IMHO, it should not. Since it was issued solely based on the Inland application, if that is withdrawn the `connected' OWP should no longer be valid.

Apologies for the late reply once again, having moved abode.

I've been asked to send in my medical as part of the PR application so I assume my application will be rejected in June when I've not submitted it.

Will see then should they make any note of my OWP. I'm not sure if I'll return to Canada or not but there's definitely some fear of being denied entry due to my OWP being made invalid. Would they still allow me into the country on a visitor visa should that be the case on arrival?

EDIT - I do tend to agree with you Ponga but as a Scot, I like to get my money's worth ;)

What I do not think will work is if you first show the border agent the OWP, then he or she finds out or decides it is not valid, and then you say you want to come in as a tourist.
I would just come in as a tourist, and only mention the OWP if asked.
