I'm trying to review all my options available to me as I'm running out of time with my work visa. Do the cic officers take into consideration what your salary is in making a determination under the cec program? I can't find a NOC code that fits my occupation and I don't believe my skill level for my occupation is C though.. Any help would be greatly appreciated.

List your duties for us to be of any help. Salary is not a requirement for CEC, although if one is earning way less than one normally earns, it raises a red flag.
 
Well I work for a pension company and well it is client based in a call centre environment. However it is technical as we need to interpret data, sometimes do pension calculations, understand pension legislation. We also initiate transactions such as transfers and pension estimates. Also respond to emails or if there are walk ins have to meet face to face with clients and discuss pension. Also assist with how to administer the pension plan to employers. Also if there is training we may need to assist the education and training to educate as well. As part of this role university or college with work experience is a requirement as well as we would require pension plan administration certificate.
I inquired with the noc people before and sent them an email but they returned back with a C code because I work in customer based environment but given that you need either university or college with work experience as a requirement for me role makes me think there must be something where my job would fit into a category in A or B. any options for this? Thanks

What is the NOC code that they provided you with?
From your description, it appears that one will require pension (can be legislation etc.) specific training to do their job. You mentioned that university experience was mandated by your company. Ask them under what NOC does your job fit.
 
Well because it's in a call centre environment they gave me the customer service one which is the C level. I don't see any other NOC that have pension included in the job description. It's either finance or advisor or other stuff. Would a human resource person be able to confirm a code if I ask them?

Yes, the HR in a company is meant to handle such stuff.

Unfortunately, my best guess would be NOC 1434, http://www5.hrsdc.gc.ca/NOC/English/NOC/2011/ProfileKeyword.aspx?val=1&val1=1434&val11=pension&val12=0&val13=0&val14=&val15=0&val16=0

NOC 1114 is unlikely, but worth looking at -

Companies are free to set their own hiring requirements higher than the minimum described in in the NOC.

And, for some reason, many entry-level finance positions were "downgraded" to Skill Level C... Unless you can get your experience at a supervisory or management level, you may find it difficult to go through the CEC program...

I don't find the noc code system fair. Anyhow I haven't explored the PNP option yet. I'm coming to a point where I need to pay a lawyer to help. I am stressed. I applied via family class and that hasn't progressed and now I need to find other options.

It doesn't explicitly state pensions but I think that a lot of the tasks are similar. You don't have to manage people to be a manager.

On a separate note, whether you find it fair or not is not going to matter and not going to help your case.

that is just my opinion of the NOC code system. But thanks for your help and I'll look into things and hope for the best :)

Have to disagree - the lead statement for NOC 0122 is "Banking, credit and other investment managers plan, organize, direct, control and evaluate the activities of financial establishments or operational departments
within such establishments, or credit departments in industrial and commercial establishments." This is a senior position. And whether you agree or not, for managerial positions, CIC tends to look specifically for personnel management activities in the job description.

Well, it's the NOC code I applied under and no, I do not manage people (and have not ever, since working in Canada). The lawyer had me prepare and sign an extensive letter with declaration of job duties (one page), and nowhere does it say that this includes people management.

Would you be able to provide me with info on which lawyer you went through? I am thinking about perhaps hiring a lawyer. Thanks!
 
I actually dealt with three different law firms over the course of the application. My employer kept changing who they worked with, so my file was passed on a few times. All three were fine IMHO and in the end, led to a successful application. I'll PM you the names.
