So confusing i need your urgent help regarding extension of WP and restoration

Hi everyone,

Anyone could help regarding my present situation?

My situation goes like this, I arrived in Canada with a work permit under the LCP on March 3, 2009, My work was expired last March 2,2011 which i have completed my 24 months with one employer and which i believed i am eligible to apply for OWP and permanent residence, Since I wasn't able to renew my work permit before it was expired, I already lost my status and I applied online for an extension of my work permit and restoration of my status and paid 350 dollars,the documents which i had attached is my previous contract with my employer. My questions are:

1) Do i Need to signed a new extended contract from my employer?
2) My employer doesn't need me anymore after my 24 months,How can I extend my working permit without a new or update contract?
3) Is that possible to extend my stay while i am in my way in complying my documents for OWP and permanent residence?


Anyone who is in the same situation out there?or have any idea regarding my status right now?I am deeply confused and worried about my situation maybe the CIC will refuse my application..Thanks hope to hear from you guysssss...thanks

if shes not gonna hire u anymore then apply only for restoration and you should find a new employer right away whose willing to apply for LMO...restoration is only 90 days so its almost a month now that u lost ur status.nowadays LMO takes long time to process keep that in mind.

you need a new an updated contract and a new LMO. before you can apply fro restoration and a new working permit.

Hi, Have you completed your 24 months or 3900 hours and submited your PR & OWP application yet?
you need an update contract to apply a new LMO first.

In your case much better to talk to your employer before she's going to release you. Tell to your employer about your situation, then if your employer is kind thats good, if not, well thats too difficult now in your part because you need LMO to prospect employer and that will took 4-7wks i guess for LMO before you can apply for new work permit. How can you extend/restore your status if you are not on the same employer?

@nylana23-this is my question to you? Have you already sent your PR application before you WP expired? If you had, you don't have any problem about expired WP because you are on"implied status". If you want to get a new employer, you apply for a new WP. youll need a new LMO, contract etc. but you don't need to file for restoration. If you have not filed your PR before permit expires, you have to send a restoration along with your PR application.

Hi guys! thanks for your replies, my work permit was expired last march 2, 2011, and I was out of status now, I reapplied online application last just a few days ago and transmitted my documents which i attached the following (a copy of a new contract with the same employer, LMO still valid til NOv 2011, a job offer letter from my employer, my detailed explanation letter how i committed the offence, TVR,passport page etc) and i paid 350 dollars for restoration and work permit.

My question right now is am i applying for an extension of work permit because I am still working with the same employer?or a new work permit?I am confused because in the letter my employer is stating that shes asking for my extension of my service or work permit not a new work permit?Do i need to revise the letter? PLease let me know, I am running out of time right now, before i already cancelled my application online because i attached my old documents, and now i want to make it sure that all the documents i submitted is the right one before my 90 days is over..

Anyone could answer my question would be a great help, and i need it URGENTLY>>Help plssssss.

Answer 1) I'm not so sure if its a must to sign a new contract or you can use the old contract you signed from the same employer but its better if you do. I had signed a new one. How did you get an New LMO? Usually your emplyer needS to send a contract along with their application to HRSDC. That contract is what you have to use. 2) not possible. New permit needs LMO, new lmo needs new contract. 3) can't stay if your work permit expires even you're on the process of getting your PR application together. You need to actually send it to CIC to be on "implied status" that's the only time you don't have to worry about expired WP.

Hi sarah,

Thanks for the quick response, Yes i was with the same employer because she agreed to renew my contract for atleast one more year, We signed a new contract for atleast one year, and a letter from my employer that she still need my service, thats what the call center agent told me i need to update a new contract with the same employer and include my old LMO which is still valid until Nov 2011. I hope i did the right thing at this time because i know it was an extension if the same employer but my work permit was expired already, and what i read in the website if it was expired it can't consider an extension but " A NEW WOR PERMIT" it can be with the same employer? pls let me know what are your thoughts and more knowledge regarding restoration and extension of work permit. It helps me a lot in this forum..many thanksss

My thoughts? It's base from experience, 5yrs as live in caregiver. Renewed work permit extension for the same employer twice. Getting help from paralegal. So I am sure. what make you think it's new WP if it's same employer.

thanks sarah, can you send me phone number any paralegal here in calgary?so i could get professional help, yes I am more relieve now, yes i think i made it right at this time, i am with the same employer asking for extension of work permit and restoration of my status, any other concerns i think god will help me to overcome this, because its really stress me out. I finished my 24 months under LCP already what made me confused before and i did'nt get the right information stating "no need to renew work permit if you finished your 24 months with the same employer"but realization comes after my work was expired that i need to keep my status valid in order for me to qualify for OWP and PR application, and now eventhough i had done all the requirements required for OWP and PR i cant still submit my documents, and i have to wait for my work permit will be approved...thanks sarah

Check CIC website and search for live in caregiver associations in your area. They are non government organizations that help all live on caregiver for free. They give legal advices and they even help you fill up forms and act as representative in your behalf if you need it. They are the best!

@nylana23- what do you mean that you have done all the requirements for OWP/PR? Have you send your PR application already? Have you already send it before your WP expired?

Sarah, i have done all the requirements for OWP and PR application as i had told you i finished my 24 months with my employer, the thing is i did'nt submitted it before my work permit was expired, otherwise if i did i understand that i was on "implied status", and now i have to wait for my new work permit before i can send the documents for OWP and PR. thanks again
