so again...im still so leary of getting married over in the states...im divorced canadian marrying a divorced american...what exactly are the steps to do this...both on canadian side and american side? i have heard about getting the "opinion letter" and then sending it off to get approved then we would be able to marry in canada...but i am wanting to skip all that crap. so what are the steps to getting married in the states? do we just bring our divorce papers and make an appointment at the court house? and someone on here did say it is as easy as that but wondered how many of u out there have done this also...hard to think it would be that easy...is there anything that may surprise us from doing it that way? cuz if it really is this easy than why don't more people do it? why do some go through the whole process of lawyer to write an opinion letter etc? tried to get info from the courthouse in the states but the one my bf went to was closed wednesdays. im dying to know!!!!! he did ask a lawyer over there in the states and they suggested to get married in canada where he will ultimately be living. i hate this crap! help!!!!!!

I really don't know about the "opinion letter," but since no one else has come forward with info....I think if you get married in Michigan, it should be a pretty straightforward process about the license. Check about the specific county (you have to go to HIS county to do it), but you'd request the marriage license up to a month before the wedding (not too much earlier because it expires 33 days later), show your birth certificates, tax info, proof of ID and age, and info about previous marriages, pay the fee, and have a witness also sign the application. You should decide now if you want to take his last name because I believe that they ask for the bride's name post-wedding in the application. I don't know what to suggest as far as proof that you last marriages ended - perhaps contact the Clerk's office for the county and ask?

Step by step:
Call Michigan - the court clerk of the county you'd get married in. Ask how to get a marriage license - mention you're divorced and find out if you need to take your divorce papers with you. Ask how far in advance you need to get the license. In Oregon, we had a 3 day waiting period (which can be waived for an extra $10) before we could use it to get married. Ask if you need to make an appointment with the judge. Finally, ask how long it takes to get a certified copy of the marriage certificate after you're married.

Using the information you get from the court, make your plan: figure out when you want to get married and make an appointment with the judge, plan on leaving so you get there in time to get the license and be there for any waiting period.

Go to Michigan. Since your fiancee lives there, it's not too far a stretch to say at the border that you're going to visit family/friends/whatever.

Get married. If you can, stick around and pick up the certified copy of the certificate.

Go back to Canada, with your certificate and as much proof as you can that you are applying for PR. Ask the border to let your now-husband visit while PR is n process.

It really is that simple :)

May 2012!
My husband and I just got married on May 5th of this year in Florida. I know laws are different in each state, but all either of us needed was our passport for the marriage license, then waited 3 days, went back, got married...we were given two marriage certificates the same day, no appointments for either visit at the courthouse. And as far as both being divorved, seems to me like it wouldn't be a problem as long as both of you brought proof, but I could be wrong.
