Should I have a baby or should I keep waiting for my husband's PR?

Hi everyone, I am a Canadian and I am currently in South Korea with my husband (Pakistani). I applied for my husband's PR a year ago and it is still in process in Manila. We don't know how much longer it will take. I am 34 and I want to start a family with my husband. I would like to have our baby in Canada. However the problem is that, because I am a Canadian by birth, and if I choose to have a baby outside of Canada, the baby will NOT be a Canadian! Therefore if I want my baby to be a Canadian then I have to have the baby in Canada! But time is ticking. I will be 35 this January and I dono if it is a good idea to wait to have a baby till my husband gets his PR since we have no idea how long that could take.

What advice do you have for someone in my situation?

Thank you in advance.

Contrary to your belief, because you are a Canadian by birth, in fact your child ***WILL*** automatically become a Canadian citizen, even if born outside Canada (such as Korea). Just make sure to apply for your baby's Canadian citizenship certificate after his/her birth. Application instructions here: http://www.cic.gc.ca/english/citizenship/proof.asp

(And of course for your baby's future trip to Canada, he/she will need a Canadian passport too. But you can worry about that later. Get his/her Canadian citizenship certificate first, because I believe the process may take up to 9 months.)

How do I know your baby will become Canadian even if born outside Canada? Here's the info straight from the horse's mouth (you're getting a sigh of relief now, aren't you? ;))

Since the OP didn't say that she was born IN Canada, only that she is a Canadian by birth...makes me think that she was NOT born in Canada.

Perhaps her mother gave birth to her outside of Canada, but she is still a Canadian citizen, since that would have been well before 2009 when the rule was changed.

If you had a baby overseas and you can't pass on citizenship, and your husband was still waiting for PR, then all you would need to do is add the baby into his PR application as a dependent to sponsor. Baby would just have a very simple medical done and their info put into a couple forms... and that's it. Baby and husband would then get PR at the same time and you would then all travel to Canada together.

Or if you were pregnant and during that time he got PR approved, you could always move to Canada and as long as baby is born in Canada it will be a citizen. Of course in this case you just need to ensure you'll have provincial health coverage for the delivery.

Thank you everyone for your response. What I meant by "Canadian at birth" is that my parents had me outside of Canada. They were Canadians when they had me but they also were not both in Canada. They were born in Pakistan. I believe there is a condition for such citizens. I read it some where that if you nor your parents were born in Canada then your baby does NOT automatically become a Canadian. Secondly, after the approval of my husband's PR I can not add my kids name in my on going application. But like I said time is ticking and I don't know when I would get my husband's PR. It could be another year or it could be 2 years later...I have no idea. Just hoping it happens sometime this year. That would be great.

Keeping my fingers crossed!

Hmmm I see. Well then you can disregard my earlier post (I mistakenly thought that you were born in Canada -- sorry about that).

Well, as per this:

http://www.cic.gc.ca/english/helpcentre/answer.asp?q=365&t=5

if your baby's born outside Canada, then he/she will NOT become a Canadian citizen =(

Thank you Fandv. What do you suggest we do? just keep on waiting since even after the approval of my husband's PR I can not add my kids in my on going application. Isn't there any loophole?

Just curious: are you the wife of a fellow member of this forum: amjad1002? Because he is also from Pakistan, and has a Canadian-Pakistani wife, who is currently in South Korea, and they applied last year through Manila too. Your stories are very similar, so I was just wondering if perhaps you're his wife ;D

To answer your question, hmmmm I am not sure if there's any loophole.....I gotta admit that this PR process is a little unpredictable, which makes it hard for people to plan their lives.

According to Rob_TO above:

If you had a baby overseas and you can't pass on citizenship, and your husband was still waiting for PR, then all you would need to do is add the baby into his PR application as a dependent to sponsor. Baby would just have a very simple medical done and their info put into a couple forms... and that's it. Baby and husband would then get PR at the same time and you would then all travel to Canada together.

Or if you were pregnant and during that time he got PR approved, you could always move to Canada and as long as baby is born in Canada it will be a citizen. Of course in this case you just need to ensure you'll have provincial health coverage for the delivery.

So I guess you can:

A. Try to conceive now, and hope that when the baby's born, your husband's application isn't done yet, which means you can add the baby into his PR application as a dependant to sponsor. But I believe it has a risk, right...? If I understand correctly, if your husband got his PR, AND THEN your baby's born in Korea *before* you guys move to Canada, then it's going to be a big problem, right?

B. Try to conceive now, hoping that your husband will get his PR soon, and then you guys can go to Canada, and then you give birth there, which means your baby will automatically become Canadian (and hopefully your birth process is covered by the Canadian gov health care, or at least a private insurance plan)

C. Conceive just when you guys have moved permanently to Canada (the safest option in terms of immigration, citizenship, paperwork. But the downside is, it's hard to predict when your husband will get his PR) (Keep in mind that immigration matters aside, pregnancy at age 35 and above is considered to be riskier...more on that here ===> http://www.mayoclinic.org/healthy-living/getting-pregnant/in-depth/pregnancy/art-20045756)

Also, you also said "just keep on waiting since even after the approval of my husband's PR I can not add my kids in my on going application" and it seems that that sentence has an implied meaning that there's a possibility that you guys won't move to Canada right away even after your husband got his PR? Any reason why? (if you're amjad1002's wife, then I think the reason is because you have to finish your teaching contract in Korea...?)

I don't understand what you mean by this. If your husband gets PR and you are pregnant, you would both just move to Canada and have the baby born in Canada.

If you have baby overseas before your husband lands as PR in Canada, then you would just add the baby into the application.

Hi yes you are right. He is my husband and we are planning a family. I think option c is the best option.
I am sorry I didnt mean that I will not return to Canada by the statement "just keep on waiting since even after the approval of my husband's PR I can not add my kids in my on going application." Actually I will be returning to Canada as soon as my husband gets his PR. The problem maybe I need to give a notice to my employee abt 3 months in advance. Which is another dilemma. We will see when that happens.

Thank you once again.

Why would giving notice to your employee be a problem? Can't you still run your business while you returned to Canada?

But 3 months notice? What kind of a job that requires 3 months notice? That sounds like you are stuck in the job and can't change jobs. Most employers are not going to wait 3 months for you to start work. Regardless of where your job is, I think 2 weeks notice will suffice.

Many executives and managerial jobs in Asia requires employees to give 3 to 6 months notice to terminate their employment.

If you applied a year ago.. then your spouse will have his Permanent Residency very soon....
I will say that better to wait because you will be moving back to Canada in a few months...
if that is what you want...
and then you can begin your family...
Too many changes at once are not good for your baby...
take one change at the time...

But I promise...
your spouse visa will be ready soon....
