Share my GCMS Notes..LOE does not match main duties..need your help

Hi everyone,

I would like to share my time line as follows,

I sent my application with NOC 4012 on June 9, 2014 and received my AOR on July 25, 2014. I was waiting for my MR but I didn’t get it so I applied for GCMS Notes on March 11, 2014. Yesterday I received my GCMS Notes. I would like to share it with you. Your advice will be appreciated.

APPLICATION: EXXXXXX REGULATION: CEC-2013 I have analysed this application based upon the documents submitted by the applicant and the information contained in the file and make the following recommendation. WORK EXPERIENCE: CEC qualifying period is 12 JUN2011 to 11JUN2014 Dates of authorized work experience – within “Qualifying Period” – in a skill level 0, A or B occupation: 19AUG2012 TO 30 JUN2014 Category of work permit: Post-doctoral Ph.D. fellows Post-secondary studies in Canada: None According to schedule 8: Work experience 1: 20AUG2012 TO LOCK-IN, NOC: 4012 selected, Full time RESEARCH ASSISTANT with XXXXXXX INSTITUTE. Employment letter(s) dated 02JUN2014 confirm(s) date(s) of employment, position title and a salary of $ 30K THEN FROM JUN2013 (32K) per year. LOE/Supporting Docs do NOT appear to match lead statement and/or a substantial number of the main duties under NOC code selected. A T4A from 2013 shows reported earnings of $30.8K. A NOA from 2012 shows reported earnings of $10K. Web-based search conducted – Online information verified. ADDITIONAL NOTES: ALL PA’S WORK EXPERIENCE APPEARS TO BE IN QUEBEC. LANGUAGE: IELTS submitted- Applicant meets benchmarks for work experience at this skill level: A.
CRIMINALITY: PA: -RCMP Screening: No reportable trace. – Police Certificates: -X Country: No reportable trace. – Y Country: No reportable trace. RECOMMENDATION: REVIEW REQUIRED BY OFFICER

‘LOE/Supporting Docs do NOT appear to match lead statement and/or a substantial number of the main duties under NOC code selected.’ It is supposed to be the main reason for second review. Details of my responsibilities and duties listed in my employment letter are as follows:
• Conduct and report literature reviews on various projects
• Design and execute experiments
• Operate batch and continuous bench-top reactors including autoclaves to synthesize materials
• Characterize as-obtained materials
• Analyze research findings, write reports/journal papers, publish findings in scholarly journals
• Make oral presentations to the research team and meetings with our industrial sponsors and to Conferences
• Mentor and support research programs of graduate students and advise on research matters.
Main duties for NOC 4012 Post-secondary teaching and research assistants are as follows,
Post-secondary teaching assistants perform some or all of the following duties:
  • Organize reference materials, visual aids and other materials as required by university professors or college teachers for lectures 

    Conduct seminars, discussion groups and laboratory sessions to supplement lectures 

    Assist in the preparation and administration of examinations 

    Grade examinations, term papers and laboratory reports.

Research assistants perform some or all of the following duties: 

  • Conduct literature reviews, surveys, laboratory experiments and other research for use in scholarly publications 

    Compile research results and assist professors in the analysis of results and the preparation of journal articles or papers.


Currently, I guess I should take some actions:

1. Submit a letter from my supervisor stating my detailed duties according NOC4012. Make sure I have some supervisory duties in addition to my research duties.
I am not sure what the VO’s concern is. I guess I didn’t mention some duties for teaching assistant like helping in supervising undergraduate and graduate students, conducting seminar and lecture sessions in my employment letter. So I will send a letter stating my detailed duties making the VO officer understand what I performed during my qualified working period.
Anyone knows these would be OK?

2. When I send the updated letter, I will explain to CIC that I would like to submit a letter providing some more detailed information on my duties in case the VO gets confused when receiving one more reference letter.
Does it work to explain like that?

3. I will submit my scholarly publications and CV to CIC as supporting documents. Will it help VO officer to determine my working responsibilities match the main duties under NOC 4012?

Additional questions:
1. Do we send any update information to this email address: CPC-CTD-Ottawa @ cic.gc.ca ?
2. Do we need to send the update information through mail, as well as a hard copy to CPC Ottawa address?

If anyone have faced situation like this or have some suggestions, please let me know. Thanks.

I think Postdoctoral fellows should use noc 4011 if they performed some teaching, lecturing or mentoring, or else some professional noc in specific field should be used. I doubt if noc 4012 can be used for cec at all as one of the rules for noc 4012 is
Enrolment in a university or college program is required.
Which means you need study permit, but work experience gained on study permit isn't counted toward cec.

You made a common mistake that you took the NOC code that matches your title, but not the NOC code that matches your duties! The majority of Postdocs in Canada do Research for 90% of their time (experiments, analysis, research etc in whatever field..) but only a very little fraction do more than 80% teaching which would put them in NOC 4011/4012. I'm a Postdoc in biochemistry research and although I supervise, teach and write papers, this is absolutely not the majority of what I do, so I chose NOC code for Biochemist and made sure that the majority of my duties are of that area. Of course you always have to rephrase the duties and can't just copy them from the website too! I've attended immigration seminars for Postdocs as well and everywhere it was said to NOT choose NOC 4011/4012 but the NOC that matches with the main duties (no matter what title is on your work permit! My first work permit: Chemist, 2. work permit: Postdoctoral Research Fellow).

However, I do know of Postdocs who chose NOC 4011/2 and have gotten PR, but the key is to have a good letter.

You should get an updated letter from your boss (department) and send it to CIC and make sure, that ALL the duties match with NOC 4011/2, not only a few. Make sure it also contains benefits, your sally and also send them all T4/T4a slips and paystubs. This Letter of Employment is the absolute key for PR CEC applications and it must be coherent with the NOC you applied under. Also make sure that your name appears on your lab website!!! CIC does online checks to verify your job and company.

I appreciate your kind advice. Before I submitted my application, I hesitated over choosing the NOC code between 4012 and 2112. Finally, I chose NOC4012 for a mistake. It seems that I have to take some actions and try to fix my mistake at present time.

Before you decide to try and change your noc I would suggest you to consult immigration lawyer first whether if it possible at all to change noc when the application is in process.

I intend to live in Ontario since it is difficult for me to find a job in Quebec. I cannot speak French frequently.

A different letter of employment won't really help that much, and can hurt (lowers the credibility of the initial letter).

What you can do is write an explanation of (A) why you chose NOC 4012, and (B) that your duties may be a better fit with NOC 2112. Just be honest, own your mistake, and offer the alternative. And rest assured, you're not the first one to make this error.
