Yes friends Decision made was infact refusal.

Here is example of how officer find nonsense reasons. Officer just don't understand how much paperwork, time and money we spend before applying. Officer not even bother to call us for any misunderstanding.

They want hard proof from us, but they give decisions based on there own assumptions.

I was working in Canada on closed WP valid from March 2009 till June 2013
I was on at client site from March 2009 till July 2012
I have provided reference letter from employer dated May 2011 which was given for issuing new TRV which clearly states my NOC and Duties, I did uploaded my pay stubs and Tax assessments.

Now officer says he don't believe I have gained skill work exp after May2011. But strangely he agrees my experience prior to May 2011, that means he agrees I gained experience from March 2009 till may 2011 which is 24 months anyway still refused my application is it just strange?

Experience Class and have determined that you do not meet the requirements for immigration to Canada.

determines whether a worker with Canadian experience will be able to become economically established in Canada. The

 knowledge of English or French,
 Canadian skilled work experience,
 Canadian educational credentials (for the Post-Graduation Stream only).

Your application was assessed based on the occupation(s) which you identified as part of your skilled work experience in
Canada: NOC 0000
I am not satisfied that you meet skilled work experience based on the information on file.
Your application was submitted on September 11, 2012. You stated on your application that you had performed functions under NOC 0000 from March 2009 with YYY Inc.
In support of this work experience you provided a letter from YYY Inc. dated May, 2011, which confirmed your employment since March 2009, as a administrator at the XYZ client site. From the information provided I was not satisfied that you have acquired work experience
in Canada under NOC 0000 beyond May 2011. Consequently you have failed to demonstrate that you have acquired twenty-four months of full-time skilled work experience in Canada at a National Occupational Classification skill of type
O or level A or B in the last thirty-six months prior to the submission of your application.

Subsection 11(1) of the Act states that a foreign national must, before entering Canada, apply to an officer for a visa or for
any other document required by the Regulations. The visa or document shall be issued if, following an examination, the
officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2(1)
specifies that unless otherwise indicated, references in the Act to “this Act” include regulations made under it.
Following an examination of your application, I am not satisfied that you meet the requirements of the Act and
Regulations for the reasons explained above. I am therefore refusing your application.

Hi PA1984,

Firstly, terribly sorry to hear this bad news.

Were your projects, duties changed after May 2011? It seems that the visa officer is basing his information provided by your company. Since you provided the info till May 2011 (the letter date). So he must have called and inquired the info for the period May'11 - Sep'12.


Still, it cannot be the basis of refusal. You started working March 2009 (you were on an Closed Work Permit, so no confusion about pgwp or any of that stuff) and it counts to 24 months to March 2011. Unless you went on 2-3 months vacation in these 2 years. Because i guess these goons are counting the total no. of hours worked - not just 24 months.

PA1984: So Sorry to hear the bad news.

I can think of one thing the officer might would have considered. Since you din't provide documentation from May 2011 to Sept 2012, he would have considered your work from March 2009 to May 2011 but since you submitted it in Sept 2012 your past 36 months are counted from Sept 2009 to Sept 2012... may be not sure...!

I don't get why they do not look at the eligibility first before starting everything... making a person wait for so long and then refuse is crazy!

I agree with you Pari Officer might have calculated from Sep 2011 n backwards till March2009 still its 23 months with 40 hours working (at that time requirement was 37.5) still I would match 24 month requirement as I have completed work hour requirements.

Yes I was at client site: So folks try to get client reference letter a well as this is getting crazy

PA1984: Don't worry your application will definitely get approved if you reapply in new 2013 rules. This time make sure you submit updated reference letter (not more than 3-4 months old)

I do agree with pari_p. The officer might have only counted your work experience from September, 2009 to September, 2012. According to you if it is 23 months at 40 hours per week, still the visa officer will count it as 23 months. Any work done above 37.5 hours (full-time definition) will not be counted towards your qualifying work experience.

PA1984, sorry for the rejection you received. Remember that the VO does not have to make calls to your employer and is within his right to make decisions based on the info you have provided in your application. You applied in September 2012, therefore, CIC will only count experience in the 36 months prior, that is from September 2009. However, your letter was dated May 2011. From September 2009 to May 2011 is only 20 months, and not the 24 months required.

When you apply again, make sure your letter is up to date and that you have 12 months within the past 36 months. You will be good then. Hope this makes sense.

Yes I understood that, Yes I will be applying as new Work experience requirement is now 12 months instead of 24.

Say If I decide to use same letter dated May 2011 and apply again how will they calculate past 36 months, Is that include current month.

If you go back 36th month excluding current month I go right to May 2010. Is it ok to reapply with same conditions as employed is not gonna give updated reference letter for sure

They will back calculate 36 months from the date they receive your application. So, if your application is received by CIO on June 15, 2013, they will count your work experience from June 15, 2010. If you use your old reference letter , you are still short of about 1 months according to the new CEC 2013 rules, hence, do not qualify.

You must include a reference letter, T4, NOA, paystubs, etc. that confirms your employment after May 2011 in order to prove your 12 months qualifying work experience in the last 36 months.

Wow! They are really nit-picking eh. Sorry to hear about the refusal. This really makes me rethink my application. Although I think you will be fine if you reapply with updated dox.

Based on that, I think you will need a new letter to apply, as that one would be out of date (ref: dated May 2011). I would recommend you get a new one just to be on the safe side.
